Wow I think they should sue SM for using the name TVXQ without their permission and ask for a share on the profit LOL coz if what DNBN wrote is true then HM shouldnt even be using TVXQ without their approval..
JYJ pretty much has gave their approval for HoMin to use TVXQ by not suing. They said they were disappointed, but that was all. I think suing at this point would be very counter-productive. They’ve taken the highroad, and I approve.
And it lets me be outraged at SME for them. That’s always fun.
they should not just stand there and let SME bully them around I say if it’s legal sue them as well..
Being always mad at SM is kinda tiring too..
but who am i to know what’s better or not for them..

wow..been waiting for this translation..It’s been 5 years since I knew and favored Dong Bang Shin Ki, while reading I can’t help but look back at those 5 years and cry as to why it has to reach this point..
I hope by March 15, the court would have a decision, and not prolong the agony–not only of JYJ but also of us, the fans–any longer..

I luv the way DNBN writes their declaration, it likes in independence of declaration in the US lol. I sure hope the court will rule in JYJ favors and don’t let SM appeal so this case can be closed soon.

I’m a JYJ biased, but somehow this let a bit sad in me.

truly speaking, T5VXQ is the group who made me fall in love with korean music and japanese music but honestly JYJ is the one who made me dislike it. *sad*
when I love T5VXQ I love the entire SMtown, the other korean boybands or girlbands or any korean singer.
I will watch some shows when the SMfam there and laugh with them. (at that time I think they are super fun people)
but lately though I said to myself don’t watch them you will not gonna like them, but I want to test my self how far I dislike them. so one day I watch TV (kbsw) and saw them (sme’s artistes) made some jokes, usually I will laughing along with the others artistes in it but that day for the entire show I can’t even made a little smile on my face, till the show end, I feel nothing. *sigh*
then I realize something, only JYJ is a matter to me now.
I will not gonna love any korean music, not until the korean music industry will treat JYJ fairness.
maybe this is only me though, because I have friends who still love them all. LoL. but the truth is I do have friends who stand for JYJ from the start too.
so this is about choice. and my choice (and a few of my friends) is Jaejoong Yoochun Junsu. >.<
There are some excellent Korean musicians out there that aren’t part of K-pop. Go to YouTube and check out 10cm, Standing Egg, and Walrus. And those are just the three I remember off the top of my head without checking notes. (Broccoli You Too. Yoochun was listening to them.)
These are the independent groups, the ones that don’t get on the music show dominated by idols. If you still want to stay with Korean music, these are the groups we should be supporting.

I actually enjoy listening radio21 even they are not play JYJ/TVXQ song.. it also have many good korean songs… and it’s not like current Kpop song.. it’s good song nevertheless.. i enjoy it^^
I agree on being an independent group not appearing on music shows… I just love it this way since most idols on music shows these days don’t attract me at all. I do hope they get on various programs out there to put their names on Korean map tho. They are too lovable and hilarious to let it go unnoticed…
Off topic but yeah, Walrus is good. I had to go to Korea and work there during a theatre festival before I knew that they have non k pop/non idol music other than trot. I guess because of the language barrier for a lot of people and also because these other artistes are not seen on mainstream media overseas, we hardly get to know about them.

yeah… actually i act in the same way like you… before those suing things I used to like some of the SM artists such as Super Junior but now I’m fed up with all of them (especilly after they said junsu is ingratitude after the tweeter things)… But I’m still listen to some k-POP music… although didn’t as often as last time I did…
oh my, we’re the same!…my friends thought i’m crazy or suffering from something since I always liked the whole SMTown, but after the Junsu tweet incident and most especially the way they reacted to it, ganging up on Junsu, I just can’t say I still like them, especially the ones who directly addressed Junsu (Boa, Shindong, Sungmin, Jay, etc)…anyway, let’s just hope and pray for our JYJ!

hun i’ve blocked homin for the past two weeks which felt nice because i didnt have to see the fanwars that are usually on those pages. all i worried about was school and JYJ but until today i found out about homins activities which made me alittle mad BUT im ignoring it

I don’t watch/listen anything related to HoMin, not because I don’t like them but it ain’t feel right to me.
I feel weird everything I see both of them doing various kind of activities. It’s fine for me to know that they continue using the name of TVXQ but deep down in my heart I know that it ain’t feel right at all.
I download everything about HoMin too but I don’t watch/listen to it lol. I know I’m weird but I can’t help myself.
For JYJ, I dare to say that they are my bias and I love them so much. They will always have my support no matter what. I feel at ease seeing them together rather than seeing TVXQ act 2 and their interview is just so annoying sometimes.
I’ve been waiting patiently for the translation to come out, and it has been well worth the wait. When reason comes to the forefront, nothing else need be said.
SME, trying to shove something down peoples’ throats is never a good idea. They might not like you trying to do that, and will turn around and show you why they don’t like it.
For guys who are supposedly very business savvy, you keep making a lot of big mistakes, ones that will cost you in the long run.

I was one of those who thought it sucked too. I liked both Coke and Pepsi, and it really was not a hardship to abandon Coke. Once it made the change back, there was this sense – I told you so! 
But when they “changed back” it wasn’t the same. That’s when the replaced the cane sugar with high fructose corn syrup. That’s why there was a suspicion that the New Coke was a front.
That aside, it does illustrate beautifully that it isn’t just the brand that’s important, it’s what the brand is attached too.
And JYj is now the Pepsi Generation!

Now that thats been said can JYJ sing some of their older songs that were sung during their TVXQ years? Because Junsu, Jaejoong and Yuchun wrote/ composed some of those songs. Wouldn’t that mean they are it’s legal owners as well?

Unfortunately, no. SME has that ‘little thingy’ in the contract that says the management company has the copyright rights to everything. That’s why they are so batshit about losing to JYJ. I’m not a lawyer, but my best guess, contract voided, like it never existed, JYJ will be in the position of getting those copyright rights and royalty rights back.
i was wondering how long have all of you been a fan of dbsk. this year will be my seventh year, and i just don’t understand how some people easily divide theirselves as jyj fans or homin fans. i can’t never see myself doing this sort of things. or maybe some of you are not dbsk’s fans in the first place.

Being a fan since the beginning doesn’t make you wiser than other fans. Well, i hate when some fans think just because they’ve been a fan for more years than others, their love for TVXQ is definitely bigger and they are superior or something. You have your opinion, JYJ fans have their own opinions too. Please respect us. There’s no need to judge our love for the TVXQ5 like that. In fact, you are a fan like us too so how come you have the right to bring us down like that. Being like this doesn’t prove that you love them more than we do.
Aldo note that the TVXQ that Homin are carrying right now is not the TVXQ5 that we love. The TVXQ5 group that we once knew is in a hiatus. In fact, TVXQ2 and JYJ are two different groups. I am a TVXQ5′s fan but i am not a fan of TVXQ2 ( there’s no personal reasons, i just don’t like their music). As for JYJ, i love their music and i support them as a JYJ fan, not a TVXQ5′s fan. Does it make me a bad fan for not liking everything ?

Actually, I’ve been a TVXQ5′s fan for more than 5 years (yes, shorter than you) but i can’t never see myself judging other fans’ love for TVXQ5 like you do.

Love is love, doesnt matter how long you have known the band, as long as you show supports. I dont think there is a senority system in a fanclub here.
i’ve been dbsk’s fan for 4 years, and this will be my fifth year as a fan. granted that it wasn’t longer than you have, but i still consider myself a huge fan of them. i went to their concerts and bought all their merchandises. in fact i bought multiple copies of their albums just to show my support.
when the lawsuit started, i felt cheated as a consumer. i couldn’t believe i was supporting the company that oppress the 5 boys i love with all my heart, so i stopped buying their products. it’s a personal choice. i still looked forward to the activities of the HM, but after their comeback, i know that in order to support HM, i’d have to support SME too. and i don’t want to do that, not when SME is putting JYJ down like what they are doing right now. HM’s statements after their comeback are words against JYJ, and as a fan of TVXQ!5, i couldn’t accept this.
i’m not saying that you’re wrong for choosing to support all 5, but do not look down on fans who have made their choices to support 3/2. we all have rights to love who we love, and to support whoever we support.
in this case, we at jyj3 support all 3 members of JYJ. most of us here, if not all, are taking a stance of indifference towards HM. we don’t go out and spread words of hate towards the 2, we’re only loving JYJ more here. of course it’s hard to ‘un’love a person you’ve loved for years, and no one is asking you to do that to any of the members. i’m just asking you to respect those who’ve had a change of heart and not imply that we’re not ‘true’ dbsk fans in the first place.

We love JYJ, and we want to love HoMin, but SME forbid us (JYJ fans) to love them by “hypnotizing” them to say hateful thing, such as singing/dancing KHD. Deep in my heart, I still think Homin loves and misses JYJ, but they could not show it since they are under SM’s under the surveillance camera 24×7. I hope someday Homin will be able to freely express their true feeling. Between now and then, I will ONLY support JYJ.
I’ll be honest and say I wasn’t a huge fan of TVXQ5. I didn’t dislike them but I also wasn’t a major fan. I only enjoyed a few songs here and there but it wasn’t enough to be a Cassie. I’ve always disliked SM ever since the HOT/JTL & Shinhwa days. At the time when all the controversies/scandals broke out, I wanted to help all of them but seeing how I was a young teen who was very naive as well as broke, there wasn’t anything I could really do.
I didn’t know about all the JYJ & HoMin issues until JYJ came to the US. What I learned reminded me of what SM did to JTL many years ago. Please google for more info! I fell in love with JYJ’s music after the realization. To many, my reasons seem a bit immature but IDC. I’ll continue giving JYJ my love and support for many more years!

At the end of the day I kind of don’t care anymore that they have the ‘name’. TVXQ will and always will be identified as Hero, U-know, Junsu, Changmin and Micky to those original 800k fans. I don’t call Homin TVXQ. Point blank PERIOD. And for the new comers of Homin and JYJ fans do research so you KNOW that TVXQ wasn’t always 2 and 2 didn’t make TVXQ a success; but 5 did. 5 freaking 5!!! 5 dollar FOOT LONG guys made TVXQ. Per-i-od.
It’s like MJ without his dances moves, vocal style and gloves history and personality. Don’t tell me it’s MJ when it’s CLEARLY NOT!

It’s all about CHOICES. For me, it’s also about quality, not quantity.
Have I been a fan for the same number of years? No. Did I start out liking all 5? Yes. Do I still like all 5? Yes. But, and here is where the QUALITY comes in. I also don’t like it when corporate entities try and ‘CRIMINALIZE’ someone for trying to exercise their human rights.
HoMin have the right to be where they want to be. Would I have preferred they joined their ‘brothers’, and carved a new path for the 5 of them. Sure. However, they CHOSE to stay with SME.
I don’t like SME. In my humble opinion they are bloodsuckers. Does this make HoMin bad people for staying with SME? No. It was their CHOICE. I CHOOSE not to support them at the present time because of SME. I don’t dislike them personally. I may dislike some of their behaviour, but that does not make them bad people. I just feel sorry for them.
JYJ have demonstrated in more ways than one, their continued love and affection for the 2 who stayed behind. I have not heard one mean or cruel thing said from any of them about the character or actions of HoMin. They have continually said they would like to sit down with them and talk – without interferrence from SME – to air out their feelings. They apparently have enough faith in the number of years spent together to come to an understanding. I RESPECT that. Again, this is where the QUALITY comes in.
So, for people who are fans of the original 5, regardless of how much time they have invested in them, and for the fans who are new only to JYJ; this site and others that support JYJ are they places WE have, to come together to support OUR CHOICE.
Think about the actions of SME and its various cohorts, SERIOUSLY, think about what they have done. If you can truly say you support what SME is doing to JYJ, then no amount of words will be able to get you to understand how folks can make the CHOICE they have made to STAND-UP for JYJ. WE, who support JYJ do so PROUDLY, no confusion. We want them to win because we BELIEVE in their cause, and their HUMAN RIGHTS.
So, if sites that support JYJ disappoint or disturb you, there is a remedy for that. Simple, just avoid them, just as we CHOOSE to avoid those that send out distasteful vibes about JYJ.
Supporters of JYJ are going to MAKE MIRACLES HAPPEN FOR THEM. So, when you go back to the sites that make you more comfortable, look around and see if you see the same thing there, that you see here, the CHOICE to love JYJ.

I think JYJ don’t even mind about TVXQ2 using the name to move on. They are just sad and that’s all.
but few days ago i read about TVXQ/TOHOSHINKI (in japanese)/TVXQ (in simplified chinese)on someone’s blog that discussed about SME and HM have the FULL right to use the name and surprisingly, they found out that those TVXQ names in any forms (except the traditional chinese) are already registered for trademark in some Korean Trademark websites. and now i’m seriously confused!
just read the article in thejyjfiles about it and the reply comment, since the answer was already written there, sorry, couldn’t explain it further, since I, myself was inexperienced in legal term.
It’s true about the chinese letter, but there’s a comment that already explained it better
This was also explained by Tohosomnia at the beginning of the lawsuit, just google tohosomnia and you’ll find it, (it’s an lj communauty but they also have a forum and a twitter account)and look for the entries entitled :

And here is a little extract of what is explained in these posts :
” Other than the Chinese character version of the members names and ‘Tong Vfang Xien Qi HERO MAX Xiah U-Know Micky’, no other forms of TVXQ’s names have been passed through the application course. Therefore, if the members leave SM, they will still be able to perform under the name ‘Dong Bang Shin Ki’. This also applies to each of the members’ individual names.”
They have trademarked the simplified Chinese, not the version that’s on everything. They have trademarked TVXQ! and TVfXQ! — those ! are very important. They haven’t trademarked Tohoshinki (latin script) in Korea – I checked – but I don’t know about Japan.
In any case! The point is SME doesn’t have a “right” to as much as they think. The people who that name represents are the ones with the rights and even the trademarks that have been granted could be challenged on those grounds.

I am not any Kpop idols group fans but I enjoyed their music and talents . I’ve been watching DBSK video and have full understanding of their brotherly bonds by just watching their manners and behaviors on and ‘off’ screen. I can safely allow young kids to idolized these five boys for their ‘never say die’ through their bad days during their time for the Japanese market days. THEY are only in their early 20s or before. Fans have a part to play for these FANWARS besides SME. YES! Support all five coz circumstances have made them change their heart or not…… just support and no bashing/swearing.It only reflects badly on your idol/urself.

I hope i-fansites while posting articles or news about TVXQ members preferable use HOMIN of TVXQ and JYJ of TVXQ or just HOMIN and JYJ. If they keep using TVXQ and JYJ, the TVXQ site banner that exclusively stand for 5 members now has different meaning or to be honest TVXQ now stand for HOMIN only. If that so, just declare the sites as TVXQ for HOMIN only so people don’t get confused anymore. This just my personal opinion.
