[NEWS] 120810 SM Entertainment and JYJ to have another trial in September

SM Entertainment and JYJ have failed to reach an agreement on the issues surrounding the members’ TVXQ contract.

The trial between SM Entertainment and the members of JYJ took place on August 10 at 4PM KST in Seoul Central District Court. SM Entertainment’s representative Kim Young Min, along with lawyers from both sides, were present to debate the issue. The members of JYJ were not present for this trial.

In the 1-hour-30-minute trial, each side expressed their sentiments to the court, and afterwards, both sides expressed their opinions to each other. This day, Representative Kim left the meeting to have a conversation with a lawyer in the waiting room. He met with reporters during the mediation and stated, “The court is still in trial so nothing can be said.”

SM Entertainment and JYJ have been in trial since last May, going through a total of six hearings to reconcile their differences thus far. However, at the end of last year, both sides failed to reach an agreement and hearings have resumed. In May, both sides expressed their points during the hearing and waited for an official verdict, but the court advised a mutual adjustment so another trial date was issued.

However, the two sides have failed to meet a mutual agreement once again. JYJ’s lawyer told Star News, “The difference in opinion between the two sides is too large. An agreement could not be reached so it was decided that another trial will take place around September 13th.”

The lawyer continued, “SM Entertainment’s side is to ‘forget about the past’, and our side is to settle all the accounts and issues in court. Both sides diverge in opinion, but the court is encouraging a voluntary agreement or a mediation until a decision has been made.”

After three years of both sides battling for an agreement, the chances of the court making the final decision have risen. When the SM Entertainment representatives exited the court, they answered the reporters’ questions saying, “There is nothing for us to say yet.”

In 2009, JYJ stated, “[Please terminate the effects of our unreasonable exclusive contracts],” and filed a case. As the court accepted this, SM Entertainment filed a claim for compensation for damages in April of 2010. In February, the Seoul Central District Court dismissed both of SM Entertainment’s injunctions against JYJ.

After this recent hearing, it’s been confirmed that the exclusive contracts signed by both sides have been nullified, and that the decision to secure the individual entertainment activities of the JYJ members has been upheld.

      This is really a symbolic picture, they are not turning their backs, they are going forward.
      Leaving for USA on the eve of the arbitration day is already a statement to those so called fans who constantly pressuring them to come back and gloriously sing as 5 again and to SM, that JYJ stands firm on their fight . Whoever thought or choreographed this picture is a genius.

      I don’t like whoever is judging either. The court has allowed the case to be dragged on for years when it could have been settled in a year, like such similar cases. But no, the court allows SME to bully JYJ by letting the case drag on and on and on. JYJ suffers because the case won’t move on. Suffers both publicly (Broadcast rights) and financially as the case keeps dragging, but SME only suffers financially (and not even by much).

        yeah, true. what will happen then if both sides never reach agreement? will it be dragged until they both reach a final agreement (which pretty much means never)? isn’t it the task of a court to give a final verdict if both sides do not reach an agreement? why drag this so long?

        I read an AKP article (I know I shouldn’t, but too late, I already did). there’s this article saying a possibility of SM giving hints in their Japanese website (as they now put JYJ names under TVXQ member profiles) about the future of JYJ going back to SM. like, seriously? I can only laugh. it’s so exhausting to read all this kind of stuffs. no wonder Junsu tweeted the way he did just now.

Helping to postpone the final “bill” that SM will have to fork up sooner or later. I’m not saying the whole court is, but who knows if 1 of the judges isn’t on the up and up? >.>

    SM is delirious thinking that JYJ is just going to let by gone be by gone just like that when all they have done to the boys is make their efforts seem like nothing to them. Still they keep on finding their low tactics way on putting barriers so JYJ cannot progress with their careers because it hurts them to see that the boys are not in need of their so called influence big company. Even if it takes JYJ their entire life they will not let their oppressor get away that easily because all they want is fairness something SM knows nothing about that’s why is difficult for them to comprehend it.     Very informative article, but it repeats what most of us already knew – that this mediation was just another stalling technique by SM in a decision they cannot win. So they go back to trial, again. How many times is this they have done the same thing. The courts just let them get away with whatever ridiculous behavior they want, failing to protect our JYJ once again.

      Yes, we knew that quite some time ago, that’s not new information. What is at stake now is how much SM will have to pay. And they have the sheer gall to say “Forget the past and come back??” Really, SM? That’s the best your side could come up with after 3 years and counting? And the court is seen to be going along with you on that ??? With THAT as your position, they want JYJ to try again to convince you to pay millions of dollars??

    SM is so afraid to lose in court verdict and kept finding reasons/ excuses to prolong this case. Shame on you! Such a low, unrespectable people running this company and I hope the other groups or members will come out to tell the truth as well. In the end they will still lose as GOD knows who is the victim and SM will get punishment soon. No escaping if they don’t make it right for JYJ.
    I pray one day soon, JYJ will be free to stand on stage again in their own country and in Japan. Be free of the pain and hardship they have endured for so long. I thank God for giving them strength and Faith to pull through all these days since their lawsuit started in 2009. Thus, one day 5 of them will be together again as good friends whether in the same group or different group. Stay strong and firm. Always Keep The Faith. God Blessed Our guys and be protected by Him.       We have a saying here in the U.S. – “Justice delayed is Justice denied.” I think that’s what we are seeing here. JYJ are being denied their honest, fair, impartial rights to a verdict as citizens of SK.

      Actually, I am hoping that one of the “meetings” they are having in L.A. is to retain a high powered U.S entertainment law firm at this point to breathe some new life and fresh ideas into their strategy at this point.

      I also wish to know the answer to this question: realistically, how long can SM continue to stall and not budge in their RIDICULOUS position of “Just Come Back” before the court steps in and makes a decision?

    They weren’t able to reach an agreement; that doesn’t surprise me. How? It’s impossible. SM just want to forget about their responsibilities and debts; JYJ wants justice. SM is desperate trying to show that JYJ belongs to them; JYJ is abroad working in their music with love, dedication and excellency as usual and leaving everybody else to be as they want to be. I encourage the korean court to apply the law in the proper way in this particular trial. Justice is a MUST; an example MUST be settled. No one can abuse, slave and exploit the employees under a work contract only on the excuse that they’re their workers and they trained them to become excellent in their field; the company doesn’t own its trainees; each one of them has a life and is worthy of respect and consideration as a human being and deserves to be compensated fairly for his/her hard work, not to be squeezed almost to death. To pretend to be the best while they’re abusing their own “children” is scandalous and outrageous. Please SME directives; you pretend to be respectful men and women, then act like that not like vulgar mobsters and abusers who only want to take advantage on the ones under your so called “protection”. September 13 is the date. I’ll be praying for the judge to settle this issue ONCE AND FOR ALL WITH JUSTICE AND FAIRNESS. JYJ, the musical glory of SKorea in the west, deserves that; the Korean government and laws owe justice to these three talented men who had the courage to defy the stablished unfair rules to show the entire world their own greatness and the greatness of SKorean music.

      Well, yes and no. They now have no enforceable contract with SM, true, but as long as the trial is without a verdict, all of the media stations, performance venues, etc. who have used this trial as the excuse to ban JYJ will be able to continue to use that excuse.

    It’s not even a surprise that the arbitration failed. As if JYJ would settle for anything less when they obviously have an upper hand in this case. SME wants to “forget about the past”? Wow, thanks for the good laugh early in the morning. These people have no shame. They have done JYJ wrong for years, and now they want to brush their hands off and avoid paying for damages and compensation? “After this recent hearing, it’s been confirmed that the exclusive contracts signed by both sides have been nullified, and that the decision to secure the individual entertainment activities of the JYJ members has been upheld.” Some fans and haters should really take notes of this and stop blabbering that “technically JYJ are still under SME” nonsense. The case has been dragged on for 3 years by SME, all mediation attempts have failed, so the court should just announce the damn final verdict and get it over with already. Justice must prevail! I keep my faith that JYJ will come out winning in the end.

      Yes, “Let’s forget about the past”, let bygones be bygones. There’s a word for this…chutzpah! The fact that they have no shame is because they have no conscience. The two go hand in hand, can’t have one without the other.

      It’s amazing how a country that wants to stand on the world stage, just doesn’t get it. How you conduct yourself regarding human rights is HUGE. The rest of the world will call you on it. Flying under the banner of democracy is more than just words, it’s action as well.

      What SME has failed to comprehend…they have a TIGER BY THE TAIL!! Long live JYJ!

      Where is that “Eye of the Tiger” theme song when I need it. :-) Oh, here it is!!

        Well, at least I got one of these calls right. lol I knew this whole “arbitration” gambit was a non-starter. I KNEW that first chance they got, Sejong would say “Sorry, no dice.” And I agree with you about the need for the court to “grow a pair” and shiver the mom and pop pension funds, which are heavily invested in SM stock, and do the right thing. Settle this case, or be seen to be another corrupt and co-opted creature of SM, Seoul Court!!

    the reason why sm wants to have jyj back is because next year will be DBSK’s 10th anniversary (on december 26th i think). so i think that they want to use them to have a lot of money…. I can’t even imagine jyj’s reaction when homin are going to do their comeback….. man the whole thing makes me depressed (i’ve been a fan of them since 2005)

    SM STALLING AND PROLONGED 3 YRS TRIAL WITH JYJ HAS INDUCED A SERIOUS MENTAL AND PHYSICAL PRESSURES TO JYJ AND THUS JYJ NEEDS COMPENSATION OF EVERY SINGLE DAY SINCE THE TRIAL STARTED.

    LSM, if you keep on stalling we will add another on you!.
    I just hate hate hate SM as they keep on stalling and toying around with the court and law.

    aigoo.. SM. Is there any tricks under your sleeve? emm.. you can’t give up easily isn’t it? Please view back on your history of losing in court. My advice: You should learn from history/mistake so then you will not repeat it in the future.

    I actually support all JYJ/2DBSK members from the moment (2005) I knew them till now. Both JYJ & 2DBSK had face hardship since they debut then till the lawsuit begin and even till now. Well I had PREDICT that DBSK will be independent from SM because of the previous senior group example Shinhwa because I think they can do well on their own.

    As a fan, I respect JYJ & 2DBSK decisions. JYJ want to terminate the unreasonable exclusive contracts meanwhile 2DBSK continue their career with SM. It was not easy to start back as 3 when fans said they are betrayers. It’s the same with the other 2 that made a comeback in early 2011 after hiatus for some time. Each team had to gain back trust from their fans and work harder to prove that they can stand on their own even after the spilt. After the hardwork there are alot of achievement from both team (to list here will take alot copy and past from MY wiki. ^^)

    Now each team are happy the way they are right now. JYJ can do want they want and challenge themselves in acting, directing, musical and others. 2DBSK also do what they want as they continue their path. If they happy then I will feel happy too. ^__^

    I admit that sometimes I support less or more of both team in certain situations. hehe.. I’m just a normal fans with big heart and sometimes a rational mind. (can’t control the hormone that hate and love ^_^)

    I had keep remind myself that a reunion of 5 members has a little percentage because after so many things happen between them and with SM in the middle. I just hope they can still be friends. It would not hurt to make friends right? world will be a better place if we make less enemy. peace!

    Fans that support JYJ please continue to cheer on them.
    Fans that support 2DBSK please continue to cheer on them too.
    Fans that support both team, please keep cheering on them too.
    Fans that hoping for a reunion of them, please keep your hope too.

    It’s not hard to cheer and wish for JYJ & 2DBSK happiness. All we have to do are support them as long as what they worked will give benefit and satisfaction to themselves.

    For fans that bash the other side.. It’s not nice to talk bad or wish others downfall right? Please keep the energy to support your own biased/ team. ^^

    However, for SM that keep blocking JYJ… what goes around comes around. (I’m not wish bad thing but we can’t deny the karma. hehe.. it’s true. we do bad thing then we will get punish for it. so we must do good thing then. ^^)

      Yes we respect JYJ and 2DBSK’s decisions.However no freinds would go in public to critisize their friends for their decisions especially when the decisions were made together at the beginning.So we can’t be freinds with both groups,just like we can’t be freinds with JYJ and SM forever.

Homin are to all appearances satisfied employees of SM, the company who is perpetrating this massive evil upon JYJ for the last 3 years and counting. They are using the name TVXQ shamelessly that the members of JYJ were largely were responsible for making great. They are even claiming the work of the five members as their own. Where exactly do you see a basis for friendship right now?

        Some certain situations just like you mention is one of the hate feeling I felt. I saw one of 2DBSK interview and after that I want to destroy something (pity my pillow that had to take the blow. huhu) After that I had keep in mind that never watch interview when they mention the trio.
        The same goes with JYJ. JYJ members are excellent in acting, musical, directing and others. But 2DBSK just get recognize in singing terms. (I know their drama debut is not good enough. TT)

        Well, my hate and love to both team it just MY feeling to them. It's because I CARE about them.
        In the end, it's up to each members to tried their best in every work because they had choose it. Then, the audiences like us well decide are they good or not and keep support them.

        It just my innocent hope that they still be friends. huh.. I don't know how will they get together after all the lawsuit and drama. Terms forgive and forget sometimes work and need time to settle it down. We can't be angry or hold grudge for a long time. (it's not good for your health and mind.)

        Forgive me for my ranting and forget all the things that I said if it annoyed you.
        Fasting month is good coz I will not blow up just because of this ranting. hehe..

          Really?? For their singing?? Is that true? Their singing is one of the main reasons why I never for a moment questioned JYJ’s decision to strike out on their own as a trio. When I heard that JYJ had left SM and that Homin was staying, my honest reaction was
          “Well, no big loss there.” I always regarded their singing talent as marginal at best. Maybe you are referring to their studio recordings. Those have been so doctored electronically for every imaginable flaw…

          I’ve watched a few fancams of their live performances — oooo, not good. Since I can’t stand listening to people sing off-key, I didn’t watch for very long. But to say that Homin are recognized for their singing…. that’s a stretch.

          My thought would be that they are popular because they are both very attractive and young girls love the way they look. :-)

          ops! sorry.. my mistake for not mention about JYJ talent in singing and composing their own music. I listen to their songs almost everyday especially live performance (i’m a sucker for live performance) till I forget to mention about it. It kinda flows in my blood already. Half space of my hard disk had been conquered by JYJ fancam. huhu.. I need to buy a new one. or I could delete some variety shows. oh no. T_T

          emm.. about 2DBSK singing, I just respect them work hard to start new and rely to each other voice. To be honest, I hate when they sing the old songs. It lost the flavor and the feel of 5 voices. TT I felt like want to scratch my nails on blackboard sometimes when heard them singing. Sorry 2DBSK…
          I can’t judge their singing coz I’m not an expert. But I enjoy their live performance in jpn especially concert. (at this point I felt not fair for JYJ that can’t perform freely. huh !)

          Enough with my ranting, the more I care about JYJ then I felt guilty for 2DBSK. The same goes for 2DBSK.

          About popularity… I do not give a damn about it. Old fans or new fans quantity for each JYJ and 2DBSK does nothing on me. However for their trust and effort to support each team are amazing! I applaud for their continuous support ! Fighting! ^__^

    this just reminds me of a classic saeguk or melodrama where the “evil” self serving guys try every thing they can to fight against the “good” guys but in the end they meet their own demise. i don’t have to say which ones are the evil and the good in this case either. may your fall be all you wished for the other guys but on your own heads instead~ just serving justice will be enough to give SM their due recompense i think. really, i don’t wish for bad for them cause they are their own worst enemies, i just want justice and fairness and freedom for JYJ and any other entertainers that will face the same stuff cause hopefully when this is all over, no one else will HAVE to go thru what JYJ did. SM is a dinosaur trying to survive in a modern business world using old methods so either they will see the light and change their practices or go down in blaze of epic failure.

    I just want to say that I am very proud of CJeS for treating the guys with fairness. They must be one of the top companies for entertainers, and JYJ seemed to make the right choice in joining the ranks of CJeS. The fans are watching CJeS staff through posts and we can see that they treat the guys with respect and take good care of them.SM is doing more damage than they realize–groups will not want to sign with them in the future because of the horrible way they treated JYJ. The boys seem very happy being with CJes. Good job, CJeS!

    SM dont want to end because it can use this to ban JYJ from tv appearance (music and variety show). But without tv appearance, JYJ can still sale album well ^^ SM you are so helpless and stupid. The one bad thing in this case is that JYJ cant make Japanese album and work in Japan as artists because of Avex. “Avex never let JYJ back to Japan til the court between JYJ and SM come to the end”

I just can’t with these people! SMH.           It pretty much mirrors what the mindset is in the world of kpop, not much of a sense of reality. There were a few who get it. I had to shake my head when one commenter asked who was YongMin. Oh, so you don’t even know who the major players are, but you have an opinion, based on what?

          Yeah, it’s kind of sad to realize the learning curve is so steep. There are quite a number of folks who are going to get screwed in life because they simply are not paying attention. Sad.

          Actually, I like this idea a lot. :-) I posted on AllKPop yesterday that perhaps all OT5s might like to band together and mount a massive campaign to boycott all SM product until they settle the lawsuit with JYJ, that being the only possible way any sort of reunion might be thought of. (OK, that part was not a very likely outcome, granted.) But I like your idea too. Why can’t we suggest that all the OT5s start petitioning Homin to stop the insanity and leave SM, grow a pair, stand up and say “no more abusing our brothers” and see if they can’t be welcomed back as a 5 member group?

          I wonder what the OT5s reaction would be to this idea? I’d lay odds that they’d refuse to do it because deep down they know perfectly well Homin would never dream of doing such a thing and WHY that might be is…well, they don’t want to think bad thoughts about their oppas. It’s sooooo much easier to just lay all the blame on JYJ. That way, they can still moon over how cute YH and CM are and their consciences are not unnecessarily bothered.

    SM is fighting a losing battle. And their standpoint to “forget about the past”- not only is that asking JYJ to forget all of what they’ve had to undergo over these years, but it also equals, in my opinion, SM taking zero accountability for their underhanded actions.

    SK court system: please get your act together, stop wasting time, and make the decision.

    JYJ have carried themselves admirably through this whole ordeal: not only enduring the obstacles they’ve faced, but creating new opportunities despite them. They deserve justice. I am so proud of these three individuals who decided to stand up for what they believe and know to be right. JYJ fighting!

    Even if more appeals are made after JYJ wins the final verdict, I rather have this case be solved through law rather than by arbitration.

    For one, we can’t trust SMs words anymore saying all these gibberish as they please. But its also a big deal, cause for once, the current CEO of SM actually went into this meeting..with JYJ not present HA.

    Also, I’m glad/relieved JYJ have been so good at keeping this case a private matter, using a representative at all times rather than by other means. Just made me think of all the scandals and breaking news of kpop stars lately. But I’m also deeply saddened we as their fans cannot know what they’re gong through cause they have to keep so hush hush about it. In the future, I hope they release their tension and spill the beans on SM. That old company is so lucky JYJ are decent people to not be dissing them at this very moment.

    Well, my friends all of you got what is going on here, you SMelled the stink. The way I see it, this company by prolonging ( and using the law to do so) this process, they are continuing to bully, to abuse, and in their minds, to teach the boys a lesson ( and anyone else who dare to shake the establishment). Just because, SMelly uses the laws available to defend their case, doesn’t mean they are not continuing to abuse. The SMelly ( and the father of the wave) can’t afford to loose this battle, not only because they have to let the boys go, but because they invested a lot to manufacture/perfect/package and sell this receipe ( k-pop/k-wave) to the world, and they can do so because they garnered government support. if the government realizes ( hopefully sooner than later) that this system is flawed. then how can they get financial+infrastructure to keep feeding this k-pop beast? LSM has a lot at steak. The man goes to universities in the states to glorify his perfected system. he is not the CEO ( a CEO is just an employee who works for the BOD), the man is allegedly the biggest stockholder, he is protecting his investments and his legacy( ?)

        This idea of “forgetting the pas” is another form of oppression when the oppressor is requesting it. The oppressor being in a position of power, thinks that it is in its right to continue to dictate how a conflict is settled. We see this attitude veiled in so many forms, oppressor-playing victim, oppressor-playing the bigger person, oppressor-invoking a moment of loss of their minds. It’s a from of manipulation, especially done publicly because it forces the oppressed to act being watched and scrutinized by the public.

    anyone know how much damage cjes/jyj want sm to pay? so the sept court is still arbitrary court, right? i mean, there’s no way sm want other choice aside from arbitrary. even if they have to pay, they would do anything to keep it off from public.

    i don’t expect this to end soon, honestly. it’s not like i can’t support jyj in this mean time…

      No, that’s still a closely guarded secret from fans and the public. I’m sure it’s a HUGE amount. My understanding is that the trial starts over again in September. You think it’s the that arbitration does? I’m not sure then — maybe you are right.

        @lilibaiyu: i don’t know… the news stated that it’s a trial, another rumor (yep, rumor) that this is an ongoing arbitration (?). but this is barely the first meeting with approximately 90 min. i thought it’d be impossible to reach agreement after years of disagreement in that short time.

        lol i just don’t want to be disappointed expecting a ‘decision’ will be made next month. if next month is just another meeting, then i’ll expect more delay… it’s annoying how it took a month to schedule another meeting thoug -.-”

          Here is a much better summary. Frankly it really makes me wonder about the AKP article yesterday. It was incredibly misleading about reporting the “new trial” – a misstatement that clearly favors SM, whose life mission appears to be misinforming if not downright lying to fans. But in the updated article it says we get a VERDICT on 9/10 which finally makes sense to me. A “new trial” just made no sense.

          both of them are actually from the same link, but the missing in translation is not a joke. trial and final ruling are both different things… o.O seriously, things like this should only be handled by experts. thanks dedicatee!

      1.First CJeS nothing to do with ths lawsuit. It’s between Jaejoong,Yoochun and Junsu againts SM Entertainment !
      2.I’ve read somewhere the amount is 3 billion won, but I’m not sure it’s legit or not .

        If I’m not mistaken the original amount quoted in an article was $3M USD. This was back at the beginning, not long after the lawsuit had been filed. But that could simply be a teaser. After all this time, I’m sure the figure has gone up, at least I hope it has.

    I always wonder how much stock in SM all these decision makers have – KBS CEO, this judge, Congress, etc.- all the people who could help JYJ.

    Also, I seem to recall that 10-12 years ago when Lee Soo Man was prosecuted for tax evasion, the judge who decided against him lost his position after that. The judge for JYJ’s trial knows what he has to do and REALLY doesn’t want to have to do it. That’s why he keeps trying for the 2 sides to make a decision on their own.

    Everyone in the country is afraid of Lee Soo Man. He is like a big mafia boss, only he doesn’t use violence, just modern techniques, like the threat of losing your job and never being able to work again.

    And also, why does being a fan of anyone in SME require leaving reasonable judgment behind. It’s like they intentionally create some alternate reality that doesn’t make sense under scrutiny I noticed it back in the OT5 days quite a lot. Couple relationships between straight guys with photo shopped pics as evidence of the relationship. I even had a conversation with a couple shipper who said that to me, she included the photo shopped pics as proof. I thought, “Fake photos as proof.” Some kind of acceptance of a fake reality as the real thing. I see that same tendency in the arguments they make about JYJ now.

    And it seems just this same reasoning which can make it seem acceptable to “just forget the past” and have that seem like a reasonable request. I wonder how many family members of murder victims would think that was a reasonable way to deal with the killer.

      I’ve discussed this many times with butterfliesarefree. We’ve felt for a while now that SM has instilled a “cult-mentality” in the fandom of DBSK that makes it fairly easy to suggest totally absurd things and then warn that a “True Fan” will not question them, that “Always Keep The Faith” means blind loyalty, forever, no matter what. It’s pretty scary actually but then they are trying to attract young kids who are still living at home, have never held a job, etc. How else could they manage to convince people that JYJ should just walk away from the fortune they made and are owed by SM and “forget the past?” For a company steeped in as much monumental GREED as SM is to actually repeatedly suggest that the members of JYJ are “just greedy – that’s why they left” is pretty shocking… Now THAT’s going to be some really BAD Karma coming back to bite them in the ass someday. You can’t treat your fellow humans as SM has done and then defame them to cover up your ill deeds and not get pay-back big time somewhere down the road.

Obvious illegal activity on their part can be made to seem legitimate and upright.

        For that reason, they evade karma’s obvious retaliation. Their use of threat, intimidation and what I assume must be bribery supports that. It will take a long time for karma to work it’s way through all that.

          Worry not. :-) Deceipt is deceipt, whether on a small scale or a monumentally grand scale, like SM’s. The universal laws of karma can not be fooled by SM’s transparent little ploys to fool the uninitiated. Their attempts to “make things appear legitimate” have been by and large laughable in my estimation. Any intelligent, free-thinking person will size up the situation and smell a rat a mile away. I singled out the Greed issue because to my mind, this was maybe the most grievous lie SM told the fandom as to why they were embroiled in this lawsuit. I believe you don’t flout the truth like that, you don’t cheat like that and if you do, you must expect payback and the bigger the offense, the worse it’s going to be. This one was big and dark and bad. And lots and lots of the fandom believed it and repeated it over and over. So payback for this one is going to be huge.

    Good, I am glad that our boys are standing firm and have decided to not come to a private agreement with SM. Since details of an agreement via arbitration are kept confidential, I was hoping that the JYJ legal team would not take this route. For many years, this ruthless company has been allowed to get away with way too many shady practices, and a private agreement would once again allow SM to make some face-saving statements to save its reputation. A public trial with its published proceedings is the most effective way to reveal SM’s misdeeds. SM’s true colors should be exposed to the general public. This way, SM will eventually be held accountable not only by its ex-employees and the law, but the Korean people as well.

    Since this is the sixth meeting, it appears that JYJ are not compromising on key issues. Glad that they are set to go the distance and hope that JYJ will not let SM off the hook. Base on the translation, it appears that the case will resume trial in September? Unless there were some undisclosed legal technicalities, I can’t imagine the court wanting to conduct a new trial altogether. But who knows! Even if we have a new trial, I don’t think this one will last as long since most of the required documents have been dragged out of SM. Unfortunately, while the first part, the validity of the contract is declared null and void–a victory for JYJ–they are still stuck on the second part, the nitty gritty part, and by far the more arduous and time-consuming phase of this trial.

    Nevertheless, I think that the end is in sight. But JYJ knew what a long and difficult journey this would be when they decided to file this lawsuit. Despite all the blacklisting, our boys are doing just fine. No matter how tough the struggle has been the past three years, they have maintained they eyes on the prize. And in the process, they have grown from boys to strong and independent men able to finally take control of their own personal and artistic visions. I am one proud noona fan! :)

    My hope is that despite our differences, we, the JYJ Republic will stay in this journey with JYJ. I can’t speak for everyone else, but I am supporting JYJ not because I pity them, but because I admire their bravery. Well, it helps that they are so darn talented and cute, too!! :) )

      It’s a MUCH better summary of yesterday’s events. It says we get a verdict 9/10, not a new trial. Frankly getting a new trial just made NO sense to me yesterday. In order to get a new trial, there needs to be a verdict first, then an appeal is filed for a new trial. So this new summary clears that up. I feel very relieved. And excited for September 10th. :-)

    Justice is a choice ????? No wonder so many notable coffee chain shops , even reported against fair trade , non-stop depriving poor coffee beans farmers, chain shops still in the prime business.

    The only way to solve these fans’ mind conflicts , is to lose JYJ forever.
    Keep supplying SM, help them extinct JYJ, this day will not be very far.

    Real cruel case is recent Junsu’s solo concert in Asia, especially in HK.
    The wound is unmeasurable, both to fans and JYJ.
    Conscience consumption, SHOULD a simple principle for all civilized buyers.
