[NEWS] 121130 JYJ’s Junsu talks about the end of their legal battle with SM Entertainment

JYJ‘s Junsu discussed his thoughts on the ending of the legal battle with SM Entertainment.

Junsu took part in a press conference at the Sheraton Hotel in Essen, Germany to mark the ending of his 1st World Tour. He said, “The legal battle lasted for 3 years and 4 months. To be honest, it should have ended earlier… But at the same time I also feel that the results came out suddenly. Having had a hard time for 3 years and 4 months, I felt like that time was not spent in vain… I heard the news when I was leaving for Germany, so I actually don’t know all the details of the settlement.”

He continued, “Because of that, it’s hard to say too much on this. The important thing is that we were able to obtain good results. I haven’t talked to the members yet, but I want to when I get back to Korea.”

When asked about what JYJ has been able to gain from the settlement, he responded, “I’m happy not because we achieved what JYJ or we wanted to achieve, but because we might have helped our hoobaes. I think we helped in making the environment better for our hoobaes. Contracts of 13, 10 years have been changed to basic contracts, and even that alone was consolation during our lonely legal battle. It’s what kept us going.”

On the issue of appearing on variety shows, he said carefully, “If this type of result allows for us to appear on broadcast, then it should have been possible three years ago when we first filed (to become independent).” He added, “I don’t know if it will be possible for us to appear on variety shows through this result. We always dream about it, but I want to ask all you reporters, do you think we can?“

One unfortunate result of the lawsuit was that there will probably never be a 5-membered TVXQ. On that subject, he said, “A lot of time passed, but one unfortunate fact is that we can no longer have activities under the TVXQ name. We wanted to fight against the company’s unfairness, it wasn’t that we wanted to leave TVXQ. It just had to happen. It’s regretful and saddening. I feel sorry to the fans, but the title of TVXQ will remain forever. But realistically, it’s going to be difficult to promote as TVXQ again.”

        @kris ~ hello , yes i applaud to Junsu ….but i prefer it is talked by Jaejoong.
        Junsu is “too young” on some sensitive topics, his personality is not reserving & always bashed by others…..

        Jaejoong perhaps more mature & always iron mind enough to control himself at press,
        though he may be very angry as well ><

        Hope this abrupt legal " settlement" will not depress Junsu on stage .
        ( pardon me for my opinion)

          Hmm i think we need to change that mindset about Junsu being too young and naive. Behind “Angel Xia” lies a strong character and an intelligent mind, and sometimes i think we give him too little credit. They all have their share of haters, but i’m glad he’s not letting them deter him from speaking his mind. And no, being the professional that he is also he amount of love he has for his fans, he will not allow this issue to affect his performance in Germany; like always it will be an explosive stage! :)

          Junsu has always been outspoken about this issue, and spoken quite well, I might add; as been said here He has only spoken the truth from his heart and that sincerity has touched many fans. If Junsu can’t speak now that the ‘legal’ battle is over, when can he??? Don’t censor him now that JYJ is FREE!!!!!

          I guess you just pity Junsu for being bashed by other ppl.

          To be honest, I consider Junsu the best spokesman out the the three. He is very well said here and always in other interviews.
          I do think YC and JJ also agree that too. If you back check all the YT videos, YC and JJ always passed the microphone to JS first to speak in every official occassion.

          yeah, i think junsu did very well. i saw a vid posted at youtube where the dbsk members had described him as impulsive (?); that he reacts first before he thinks but i believe this is just for being playful or humorous. for me, junsu is very sensitive and smart. he conducts himself very well on interviews and make good judgements…i think what you mean was that because jj is their hyung and it would also be fit that he speaks first about the matter or all the members are together when they express their feelings about it.

      I disagree. I like Junsu’s interviews on this subject most of all. I do not see any immaturity in him. He’s just a very stern, straightforward person behind all of his usual cheerful demeanor(actually a pretty attractive trait,IMO). JJ has said that he tends to let things build up in him, so while what he says may sound smoother, it may not be t his true feelings.

        agreed. Junsu is a Saggitarius, he is very straightforward and because of this sometimes he might sound too honest and blunt about his opinion. I know, I’m a Sag too. But he is not immature. His words here show the exact opposite. He gave a calm and truthful answer. It’s not in his nature to deceive others (another Sag trait). Jaejoong is the sweet talker but that doesn’t mean Junsu is not mature in handling media. I see the exact opposite. And I have long grown out of my “pink cloud” fan stages, I’m 5 years older than Junsu.

    I feel so sad that the legal battle has ended but it seems like nothing is going to change. Cjes and now Junsu confirmed that the possibility of JYJ appearing on TV remains very low. All TV stations still refused to give them a chance. 3 years ago when they filed their lawsuit, I always thought that the lawsuit would end with SM losing and JYJ freely promoting their music. But here we are with this crappy settlement that doesn’t promise us anything.
    I wish we could see the settlement details because it is just so unfair that after how much JYJ have gone through, they still can’t enjoy the true freedom that they deserve. I kind of knew that the lawsuit would end this way when the court refused to grant JYJ a final verdict and forced them to go for an arbitration with SM. It upsets me that SM seems to be untouchable in SK. Maybe they are just too big to fail in SK government’s perspective. They still want to spread that stupid Hallyu wave. Hope that with the failed Kpop festival in Vietnam (the one that has more than 70 different artists including TVXQ, SNSD,…), the government will realize that the “wave” they treasure will not be able to continue without true talents like JYJ. No one is going to pay to hear crappy songs from those who can’t even hold a note.

        Oh, there was a Kpop festival in Vietnam yesterday and obviously it didn’t sell too well even though it was promoted heavily. Of course, there were other factors at play but only about 3,000 fans showed up while the capacity of the stadium is 40,000. (Jeez, Jaejoong alone can sell out 3,500 seats with his fanmeeting where he sang only 2 songs.) You can see picture here: http://ione.vnexpress.net/tin-tuc/showbiz/music/2012/11/40508-dai-nhac-hoi-kpop-chua-du-nong-phu-kin-san-my-dinh.html. I don’t know if you can read Vietnamese but there is a picture in that article showing the turnout of that event (One commenter in that article said that she bought last-minute $100 VIP ticket for $2.5). It’s funny because just a week ago, 2VXQ sent out a message saying that they are not going to have any other event in Vietnam in the next 10 years. At that time I just thought “Oh, whatever” but now thinking about it, I bet it was because tickets were not selling well so they had to say that to push fans who were still hesitant to go and buy tickets (5BSK is extremely popular in Vietnam, they have the biggest fanbase. In fact, most fans who showed up at the event are 5BSK fans). Still didn’t work I guess.

          must say, SM town tour , and its various groups tours have been too frequent and content same same.
          Most fans are going broke now. (include china, taiwan , hk)

          Even the best ATM machines need maintenance , yet SM doesn’t care.
          Keep ” robbing” fans wallet with below standard music or merchandize.

          For MAMA 2012 HK, even hot blood BB fans are “purse – broken” after their recent concert.
          So many are not able to buy expensive MAMA ticket again.
          But surprisingly, the tickets were ” SOLD out ” :P
          well, hallyu got some tricks ? i m not sure.

          Take 2013 tours for example. The massive scale is like trying to pull out the last tiny grass from the

      Indeed. Nobody indeed. This is what the SK government is going to have to get its head around next year. SM has been LYING TO THEM about what they can accomplish with their version of the Halllyu Wave. It’s all been smoke and mirrors, SM top brass has enriched themselves immeasurably and oops! coincidentally severely damaged the prestige of the democracy of SK with their shameful conduct re: JYJ.

      SM can’t have it both ways. They can’t operate as the ambassadors at the forefront of the international Hallyu Wave and behave like gangsters. That won’t wash. It’s only a matter of time before the western media smell a rat, have a slow newsday at home and jump all over the story.

      LIkewise, as you said, they can’t put on massive K-Pop extravaganzas in other countries, all under-written by the SK gov’t featuring groups who can’t sing. That won’t wash either.

      SM is in an uncomfortable position. They’ve dumbed down their criteria for recruiting new talent to be “those who won’t think they can have an independent career and think of suing to be released.” So now all they have is mediocre talent with more, or more acurately LESS in the pipeline for the future. Not exactly a scenario to present to a nervous group of stockholders ready to bolt. And OF COURSE they will lie to them, but the reality is … the truth is out there. It’s getting out. The cat is out of the bag about what a rotten to the core company SM is.

        All that you said is so true. What, I wonder, will those who claim they need more time before making a decision about putting JYJ back on entertainment shows, need to help convince them? How about copies of these photos, along with the story about JYJ’s 4 day membership/fan meet expo that brought out 22K fans, 7K from Japan, and added about $10M dollars to the SK economy.

        These cretins cannot have it both ways. Banning a group because they chose to fight for their human rights, but allowing others who cannot fill up a stadium, is not looking good at all. Don’t they realize this kind of information can be spread around the globe faster than you can blink?

        Shooting yourself in the foot is a bad idea. And you really shouldn’t aim for the other one as well. Hobbling around on crutches gets old after a while.

        Or maybe that translation was correct, too. Every time the boys have an interview there are hundreds of news coming out and each of them is slightly different although the topic is the same. It only depends on the writer of the article how they arrange the words. I’ve read that too but I didn’t find it offensive at all. Why is it so unbelievable that Junsu can be sad about the past? DB5K was a huge part of his life but it’s over. They were practically forced to leave their past behind, he can mourn that but that doesn’t mean he can’t be happy now. They made a new name for themeselves, we love JYJ, they are successful on their own, they still stand tall and proud. And free. But he can feel sadness for a while about finishing a part of his life that gave him so much happiness once. I don’t find it strange at all.

      He did seem a little surprised to hear the news, but I’m sure JYJ had already discussed amongst themselves & informed their lawyers of their primary goals as well as the concessions they could live with. He just didn’t expect they’d reach an agreement that day especially with the way SM lawyers had been dragging their feet.

      The primary goal was, of course, that JYJ be officially and legally liberated from the SM.
      Not only did they accomplish their primary goal, but made absolutely clear that they should have been freed from the time they filed suit letting the public know, irrefutably, that they’ve been right all along.

    Once I realized that the two largest shareholders in SM (after LSM, of course) are the SK national pension fund and Hankook Bank, I gave up on JYJ getting any money from SM – or anything that would further damage SM’s stock price. It’s game over in that regard. The oligarchs take care of each other and the status quo. But, things always can change. It just takes time. In the meantime, the lawsuit is over. That’s progress. JYJ hwaiting!

        SM stock has been falling in a couple of days after they released their income statement. It’s a 25% fall in stock price and certainly it’s detrimental. Sadly, it was just enough to wipe out all the gain in stock price they have enjoyed since July of this year. Their stock is still high. As long as SM still can manage to fool people with its “strong” sales and “dominating” presence in the entertainment industry, their stock will recover soon. They already own all the press in SK so they can always blow their little success out of proportional. It’s just ridiculous how they present themselves as leader in the industry when sales in all of their strong markets are falling without a parachute. SM is just all hype, no more, no less.

          My own take on SM’s sudden lack of interest “in holding JYJ to their contractual obligations” and settling this lawsuit is related to this fall. I’m sure that 3Q report made a lot of people wonder how SM missed it by such a big number and made them wonder about how they keep their books. JYJ wanted them to answer the same question but SM somehow has always managed to avoid doing that.

          I think SM knew if the lawsuit with JYJ went on any longer, they weren’t going to be able to hide those financials so they had to get rid of that lawsuit fast before they accounting records became public.

          @dbullock , those are my thought exactly. I definitely think the stock fall was a factor in this coming to an end. As you said, it’s going to be hard to weasel out of being accountable to your investors than the judge you have in your pocket. They’re going to have to tell/show someone something and they didn’t want that being used against them in the suit.
          And i’m sure the ruling against the distribution company in favor of C-Jes added to their worry that this could turn out very badly for thrm. It was better to say let’s all walk away and make up a lie to tell their ever gullible fanbase

    Well, if the comments on AllKPop are anything to judge by, the whole K-Pop World are now JYJ fans! :-) WOW! It’s by a landslide ALL POSITIVE for JYJ to be happy and be back on TV again. Much was made of the sacrifice they made to benefit all idol singers with the improved contract conditions, etc. that came about as a result of the lawsuit. OK, guys — this is MAJOR. The tide of public sentiment has turned. I’ve been looking all day for a bastion of anti-JYJ sentiment and I can’t find one. This has to be capitalized on! Let’s push through and get JYJ back on TV and on radio in SK. That will put them in line for the top honors in all the award shows of the future.

    My prediction (and I do have one lol) is that JYJ are going to emerge from all of this as THE premier, celebrated pop group of SK.

      what do you think swayed the public? are the improvements in idol’s rights resulting from jyj’s case now common knowledge?
      i wish that more articles mentioned that jyj actually won the big lawsuit and were just unable to get compensation from sm. most make it sound like it ended in a stalemate with no ground being made on either side… but it’s more like when you get the kids you are babysitting to bed, but then can’t get them to actually go to sleep lol…

        I think for the most part, regular Kpop fans were reluctant to say anything in support of JYJ because of the vocal antis and their argument that JYJ are greedy and are just after money, money, money.
        In the end, freedom from SM was what mattered most to JYJ (as it always had) and not the money. No matter how antis try to spin it, that is the absolute truth. That’s something even the most layman Kpop fan can respect.
        (Except those crazy antis of course).

          I’m kind of thinking that a lot of those antis are daytimers sitting in internet cafes being paid by the post by SM to write disagreeable comments. We all know at this point that this happens. I’ve checked around today and I have to say that overwhelmingly the tide has turned in favor of JYJ and their wonderful emacipation from SM. There was scarcely a negative comment to be seen anywhere and that hasn’t always been the case! (OMG! Understatemnt!) Let’s give it another couple of days until the reality sinks in. I think fans will come flocking back to JYJ now that the stalemate is over.

It just seems that the haters don’t bother entering JYJ’s articles anymore, some enter but don’t comment… I mean there are 80,000 views and only 400 comments.. which means the haters scrolled at the comments, saw how happy everyone was, and felt a little ashamed to bash at this time…I find a lot of haters on other articles, when JYJ fans bring up JYJ in an SM article, the haters rise up and I find thousands in one article >_< There are just too many JYJ haters in the kpop world, because SM basically has a much larger fan base who mostly hate JYJ.. But at least they are all minding their own business right now and not ruining the moment for us..

      I'm a little confused on this part “I heard the news when I was leaving for Germany, so I actually don’t know all the details of the settlement.” So basically the agreement was made without JYJ's consent? Are the lawyers the ones who decide on their own? How does this work?

        Yep. Haters don’t need money, they only need hate. I really don’t think SME pays them anything. Trolls who read what they want to read in order to reach their own conclusions about JYJ don’t need any incentives.

        I know many people have “ideas” about this website and many admit they have never bothered to read the comments or articles here.
        It is upsetting that they don’t bother to get their facts straight about JYJ. It has been so long yet none of these people know the basic facts about the lawsuit or JYJ as individuals. I know antikpopfangirl is the biggest piece of shit of a site but I can’t help but get upset. Some of the commentators there have this idea that JYJ left “with” Homin’s money…..let that sink in….yeah…. They think that JYJ are also trying to get other artists to “rebel” so that they can all be paid a fortune and show up to work whenever they feel like it, hence “destroying” the discipline of Kpop idols. I know many are just dumb trolls but there are others who MEAN this stuff. I can’t understand how people can be like that. They also don’t know that the court ruled TWICE in favor of JYJ way before this settlement. All that was left was for the amount owed to JYJ by SME to be determined. They thought that they were still in court debating the validity of the contract.

        Then there are some Homin stans. I read this article in other sites and many commented on how Homin never speak about this issue. They keep silent and that makes them “dignified”. Apparently getting screwed over by SME and then having the nerve to do something about it is a source of shame for JYJ. They keep their answers short and simple, “Nope, it was always about greed and money not DBSK.” They think that means that they are right and can dismiss anything JYJ says as lies. JYJ filed an injunction forcing SME to review their contract in hopes of better pay but SME found it easier to to block their requests and slowly start a smear campaign in which JYJ were painted as greedy and wanted to leave DBSK behind while Homin were “good” and loyal sons who were happy with their fair contract.

        I can’t understand how they can’t just stop and think. If JYJ really were making stuff up and getting unreasonable then SME would have been in their right to annull their contract. It would have been so obvious that JYJ were just being selfish and they could have left it at that. JYJ would have embarrassed themselves and come running back. But no, JYJ’s demands had validity so they lied non stop since the beginning. They lied about CreBeau, they lied about Homin’s original involvement before they backed out, they lied about the cancelled concert in China and not once did they hand in any records about their finances to the courts. HOW can people still believe them?!! Do they really have shit for brains?

          Yeah, I’m totally agree with u! MAMA awards has been indicated with “unfair judgments”! All artists won on MAMA Awards after 2008 mostly were in SM. I’m so pity of JYP and YG. Really nuts! T.T **E seems can control all awards in SK but many people knew this as “public secret”. But you know, actresses/actors from **E never had many awards than YC or JJ did! And their dramas never had high rank/reviews from public. So stupid!! For example To The Beautiful You, Love Rain (below 8%). They only had “face” but not “brain and talent”!

          Heechul made comments about “slave contracts”. He never mentioned Hangeng or JYJ but any fool could see he was talking about them. He said that it couldn’t be referred to as a slave contract because he has money to pay for his parent’s house and that if people had the time to get drunk or go to a party that they couldn’t be called slaves.

    Wow!! I really admire Junsu responses to these questions. And, he said that he doesn’t do well when it comes interviews by himself. Junsu, Oppa! I have to say you are very WRONG! You do very-well on your own. You gave the best answer you could. But, I do have to say he’s right. The fact “JYJ” spoke out against “SM” they did open a door to a new era allowing their hoobaes to have a least a better contract with better terms. Although, JYJ lost a lot of things but they clearly GAIN SO MUCH! They did something most idols probably couldn’t do in the past and that was raising their voice to unjust matters. Like, what Junsu said. They did not purposely leave TVXQ but fought against the “COMPANY UNFAIRNESS”, I know it must have been VERY HARD for them because JYJ truly love their fans and the bond that they had as TVXQ members.

    But, the fact is …they were being treated unfairly. That alone is OUT OF THE QUESTION. I don’t know about you guys but if I entered a business and work my ass for so long and didn’t see anything from it. I would say something. I would put up a fight. That is just my character and personality. Yes, I will “BITE” the hand that fed me but it wouldn’t be in VAIN! or due to selflessness but because I knew what was going on was wrong.

    Sometime, while following your heart…it can make you lose a lot but in the end you gain so much more. And, the truth is..what you lose isn’t the end but the beginning. Because, with this new beginning you can make amends with the PAST!

    I really do want them to be on variety and entertainment shows. They truly deserves it. Their appearance will help boast up the ratings for any show!!~ That’s a GIVEN!

I am really proud to you and JYJ, despite being hated by some people who always said that you guys greedy or called you as a traitor but in fact you done a hard but very meaningful job. You guys know what the consequence from your guys act but you let yourself became a sacrifice for all of these long battle to create abetter environment to anyone who wanna be an idol. So if there are still many people hates and called you as a traitor then let it be…….because there are a fact that never gonna be changes, there are no more 13 or 10 years contract for hoobae because your effort.
    It’s no matter if you can or not to appear on TV, your fans always gonna stay with you, watching you and support you like always.

    Reading this, i kinda understand now, why SM brought TVXQ in their statement and why there was an agreement to not interfere with each other activities (eventho we know it was SM who always do that) and why even Junsu still think that JYJ would be show up on TV easily.

    Maybe I’m reading too much to it. But when I read SM statement, I really don’t understand why must they brought up TVXQ name. Everyone know (except for haters n antis) that the lawsuit its about JYJ vs SME. And SME never even mentioned about JYJ vs TVXQ coz usually they just said that JYJ are ungrateful n greedy people. And why must they boldly n shamelessly mentioned about ‘not interfering’ while it was them who were caught n fined by KTC for interfering with JYJ activities. But now I’m kinda understand.

    Maybe, this is just my speculation. But I think maybe JYJ part of the agreement was for JYJ to agreed that they wont pursue rights of TVXQ’s name. as many know, SM tried to copyrighted TVXQ’s name before. but the court declined and stated that the name belong to the 5 members, as TVXQ is about the 5 members. So maybe the agreement also included that JYJ wont claim TVXQ name and rights again. That’s why “no interfere” part included. But not for SM to not interfered with JYJ activities again. But for JYJ to never claimed anything that they have when they were in TVXQ. Maybe like the songs. We know Jae, Chun and Su have copyrights for TVXQ/THSK songs. And we know that from the last TVXQ2 concert that they mostly sang TVXQ5 songs. So maybe the agreement also included about it. That’s why even the lawsuit ended and they have ‘no interfere’ agreement, but the members, Cjes n even TV Stations shown a negative sign for the possibility of JYJ to be on TV. Coz the agreement not about that, but more to SM to not claimed any right on JYJ activities and for JYJ to let go TVXQ’s name and rights, to JYJ is JYJ, and TVXQ is for HoMin, it maybe also including not singing TVXQ5 songs ever again. Maybe that’s why Junsu mentioned that the sad part about they wont be able to do activities using/under TVXQ name again.

      Actually I don’t think JaeChunSu do have copyrights to any songs they wrote or contributed to while with TVXQ/THSK… part of the issue with the contract with SM was that the copyright of all albums and songs belonged to SME regardless of if the wrote, composed or arranged them. SME could use those materials with the members’ permission but the members could not use them without SME’s permission.

      The whole contract with SME basically said “What’s ours is ours and what yours is ours also.”

          umm, actually, as the songwriter, they still have songrights, aka songwriter rights. it was the law. and SM usually put their name if the song was written by them. it was the copyrights that belong to SM.

      If the agreement was for JYJ to not use any material from their time in DBSK in exchange for SME to back off and never interfere with JYJ’s activities then there would not have been any doubt expressed by CEO Baek. It would have to had been a fire-sure agreement otherwise it would have been a complete fool’s move on behalf of Sejong Law Firm. Why would they give up their rights over DBSK if they have no guarantee that SME won’t go back on their word? Homin + JYJ have all rights to the DBSK name NOT SME. JYJ and Homin (together) would have to file for new ownership of the name, JYJ gives up their rights or all 5 agree to transfer the ownership to SME, and believe me, if that were the case, it would be all over the news.

      The reason that hasn’t happened is because JYJ is not stupid and all 5 original members need to be on board not just 2 or 3. JYJ won’t do it because their intention was to claim their fair payment, not to leave the group, and it might be the only last resort if SME continues acting the way they have. SME shamelessly used Homin and the name to promote itself once again. That is why JYJ were so shocked. They used the name JYJ because they know that DBSK is for all 5 members. Homin’s elementary school logic is that since they didn’t go up against SME they see no reason to not use the name hence their “keeping the name alive” nonsense they spouted in the beginning. They believe that DBSK belongs to SME not to them or JYJ because if they did they would know that no matter what SME does DBSK is legally theirs and JYJ’s.

      SME simply tried a last cheap shot against JYJ by claiming underhandedly that JYJ caused “harm” to Homin with their greediness and the lawsuit.

    I’m glad they won the lawsuit. However, I’ll believe it when I see—-When JYJ are actually on TV shows and not blocked or allowed because SME seems to pull all the strings.

    I’m probably gonna get SO much hate but i truly believe this. What I think what happened is that JYJ first separated from SM because of that makeup company and not being able to put their money into other businesses (also not being payed properly) they stood up for their rights and I really respect them. Now because Yunho and Changmin weren’t in the makeup company deal they didnt really have an issue with SM. After JYJ probably sued SM.. and JYJ told Yunho and changmin that SM couldnt do without JYJ and they’ll be together again soon. ( I seriously doubt JYJ wanted to completely seperate from SM because they have honestly been with them since they were young… all of their friends were there as well! Just think about it as logically as you can. Why would they seperate from one of the biggest entertainment companies?) What JYJ wanted was SM to change their contract. They thought about this logically… if Yunho and Changmin remained in SM while JYJ sued SM they would HAVE to change their contracts for all of them to be together. I mean come on how would Yunho and changmin not know about this? Junsu even tweeted “Hyung…. we all thought the same. They were the enemy of all five of us” I mean… Its the best strategy to get SM to change its ways right? Its not only about SM either its about AVEX too. Now after JYJ sued SM… They were probably like look what we can do without you… and then did all this things with AVEX while performing with Yunho and changmin (who didnt seem to be that pissed… I thinkn they also believed that SM wouldd also change their contracts/pay up what they loss) Why else would JYJ wait THREE years? Three effing year. Even in 2010 their interviews seemed like they were waiting for SM… to kinda start bending over to them. But honestly… by the end I think so many things happened btween them that its too late to change anything. Even Yunho and changmin went their seperate ways now. You know three years is a long time… people change and circumstances change. I am happy that both parties found hapiness after everything that happened. (I know I may sound crazy but its just a hypothesis of what I personally believe happened)

      Ok……If this did indeed happen then that really doesn’t speak well of Yunho and Changmin (not that they stand so great now either) but wow…..

      A lawyer who gave legal advice to JYJ claims that he met Changmin as well. Their own parents also gave them away when they claimed they were well aware of the boys’ plan to start an injunction against SME and were “against” it since the beginning. Even OT5s express doubt that Homin didn’t know what was going on. I think all 5 had legitimate grievances against SME but only 3 of them went all the way.

      Homin’s parents may have played a part in their decision to back down or maybe their own misgivings who knows? Really that isn’t the issue. The problem is they lied so shamelessly and claimed they didn’t know why JYJ filed the injunction and they went along with SME’s smear campaign by involving CreBeau. JYJ invested in one shop while Homin and SME made it seem like JYJ were hot-shot businessmen or something. Even so, no cigar, because JYJ used their OWN money to invest in that shop not SME’s. SME either wanted a part in the dividends or they wanted JYJ to not make any investments which was unreasonable, period. They won’t pay JYJ what they owed them and now they want to cut the only other possible source of revenue for them? That is why I can’t to this day understand people who side with SME. The stupidity of all of this is just outstanding.

        Appreciate so much for this precious memorandum, this is the CORE reason i bye bye to Homin, and never spend a penny , nor try to click SM any MV on all media.

        3.4 years gone by, all their BS accuse all can’t stand.

        JYJ perhaps not having high academic success parents like HM did, but their statement has been so consistent, i trust their testimony in court endure ALL cross checking.

      ???? I almost STOPPED READING RIGHT HERE after your second sentence. Because when you said WHAT I THINK HAPPENED… well that let me know we had entered the realm of fantasy.

      Call it “hypotheses” or call it fantasy does not matter because there is something called THE FACTS. And THE FACTS of what happened especially concerning the cosmetic company, HOMINs response, and the courts decision concerning JYJs contract with SME have been documented and clarified over and over for the past three and half years.

      FACT >> The former contract between JYJ and SME was invalidated by the court in October of 2009.

      If you understand that fact alone, then your whole ” hypothesis” simply evaporates.. JYJ was not waiting for SME to change their contract these past three years the contract had already been terminated in 2009. These three years have been about reaching a monetary settlement.

      For those who really want to know the truth and have taken the time to be INFORMED about the truth, there is no need to speculate or try to create a story that seems to fit a desired outcome. THE TRUTH IS OUT THERE seek and ye shall find.

      My comment is not about hate…but please listen and listen carefully. I probably should supply you with the link, but you can find it on TheJYJFiles…the court decision about the contract and the cosmetic case, clearly states this lawsuit WAS NOT ABOUT THE DAMN COSMETIC COMPANY! There fixed it for you.

      Please go and check out the court’s decision and then come back and let us know how you interpreted the decision. This was never about Crebeau. That was an SM smoke screen. PLEASE do not allow yourself to continue believing this. I am not trying to steer you wrong here.

      When JYJ signed their contract with SM, they authomaticly agreed that all songrights and copyrights and resulting royalties from their self-written songs belong 100% to SM. It means not only they´ve never seen a penny, but also SM can change or sell or other use any of their songs and JYJ can´t do anything about it. This is very different from normal situation in the music industry and according to the latest Fair Trade Commision manual it is now illegal to have such contract in Korea. When J-J were kicked out of SM dorm, all their ipods, harddiscs even normal paper sheets were confiscated by SM because they could have some unfinished songs on them that by their contract also 100% belonged to SM. That had to be a pretty humilitating situation.

          I don’t even know what to believe. People say SuJu did really good this year and other says that isn’t true, same for TVXQ and SNSD.
          At this rate they can just take turns until Girl’s Generation have kids and SuJu end up in a mental asylum for all this crapola.

          I defintely know Ailee deserved her win. I find that she hasn’t quite found “her” own voice and style but she blows away all the other hacks when she sings.

          I’m sorry to tell you but SM routinely buys chart positions. They’ve done it for years it’s been well documented. So you can never ever know for sure whether their act’s releases are actually selling or if they are doing buy-backs and pay-offs to the companies who put out the charts. THIS is the essential problem with SM. They are liars, they are dishonest when it suits them, there is nothing beyond them in terms of behind-the-scenes manipulations of events to get what they want. So what can you ever believe that they say??

          In lieu of an honest and forthright company who wish to compete fairly, ALL SM groups must bear the burden of having their so called achievements be suspect.

          So question is HOW DOES ONE GET NOMINATED FOR A MAMA? According to their own site the INITIAL SELECTION is based on album sales and song ranking>>>>: ” -Preliminaries: Based on the evaluations of Mnet expert judges and other music affiliates using album sales + song rankings (Information from various music sites)”

          So MAMA if that is the case I say be transparent and publish how you made that PRELIMINARY SELECTION of the artist to be considered. Is it the numbers or a combination of the numbers and subjective evaluations? Is there a factual Preliminary Qualifier where anyone who meets it can be considered? Or is your process simply subjective… ie BY INVITATION ONLY?

          See if I’m the only fish allowed to swim in the race then sure in a competition against myself I will always be #1. It’s not a real competition unless all who are qualified to compete are allowed to compete.

          See Julie you talk about fair.. FAIRNESS IS ABOUT TRANSPARENCY without that one cannot say anything is Fair.

          I’d like to ask MAMA to be TRANSPARENT and publish how the pre-selection was made. Is it truly based just on the numbers, rankings or just subjective evaluations of your hand picked “Expert Judges.” Is there a FACTUAL PRE QUALIFIER that allows anyone to participate? Then publish it! Without this transparency concerning the artist pre-selection process it would seem that Nomination is strictly BY INVITATION ONLY.

          So see if I’m the only fish invited to swim in the race then sure I will be #1. It’s only a fair race when all who are qualified to compete are allowed to compete.

          Fairness is about Transparency … if they are not transparent then one cannot say the event was fair.

          Check the Judging Standard chart and check the percentages given to the Judges and the Selection Committee. In any category they can turn the decision in the direction they choose. Unless the judges are voting by secret ballot it is difficult to trust the final outcome.

          I was talking about the already choosen nominees and the awards given. I’m not talking about how they choose their nominees(which is what you’re talking about) I said it’s one of the fairest MAMA not that it’s completely fair.
          In the case of JYJ, nobody is fair and i don’t think someone will be fair with them before a long time.

          I get what you mean, since as you scroll down the names, they are not just confined to SM and YG which was usually the case for the last few years. Only SuJu got more than one awards from SM, Shinee and Fx one each, the rest of SM groups have none, I’ve read Boa, SNSD and TVXQ are among the nominees, and no 2NE1.
          It’s the fairest among MAMA’s roll of winners all these years, not the fairest of what supposed to be the standard of all.

          If something is not completely fair then it’s not fair. That’s the distinction the word fair actually makes. Yes I understood you were speaking of the already chosen nominees.. But the point I was making was that if the process begins in corruption with the selection then it is also likely the final selection ie the chosen nominees too will also be tainted.

          The fact that prior years were dominated by SME artists and suddenly this year few of their artists well that does not speak well to the current state. See it confirms MAMA may have been tainted in the past and bribes accepted in the past and nominations went to the highest bidder… and we don’t know if they’ve turned over a new leaf.

That is what we want… I don’t want SME artists banned or YG or CUBE or any other management company… We can’t define fair as the EXCLUSION of even our enemies. If we do we’re doing the same thing they’ve done to JYJ these past three years.

          It almost seems as though SME might at last be apprised of the fact that THE REST OF THE K-POP WORLD has grown wise to their tricks, their pay-offs, their various sleazy attempts to co-opt the glory.

          You know I hate to be a broken record about this, I know I am boring to some, making the same points over and over. I also feel I should apologize to julie for the seeming pile-on that happened this afternoon, although to be fair I think it’s worth pointing out that if you are planning to show up on to JYJ3 with an unsupportable position, you’d best understand what is likely to happen. There are incredibly savvy posters here, lots of them, people who know their stuff, who have done the homework, who have done the research and who have the facts about this situation re: SME. For myself, I have spent the better part of a lifetime in the music business, I have an abiding interest in the rights of artists and I have followed this case carefully almost from the beginning of it. I have DONE the reading. There’s a lot of it and I agree it’s not for everyone. It’s for those who have a real interest in the truth of this much reported on case, with all the associated spin from the various factions with an axe to grind against JYJ.

          I’m so incredibly glad it’s over now and that the members can get back to normal. The stress must have been overwhelming at times as each new setback and bit of slander was reported to them. Even as lately as today I read that the Korean press is reporting that JYJ’s efforts re: the lawsuit have been in vain. Huh!!?? Oh, SM, SM. STILL making with the spin to suit your purposes. I guess you can’t teach an old DOG new tricks.

      Best Female Group, Best Vocal Performance Group (Davichi – clap,clap :) ) Best Global Group Female – Where’s the most popular group SNSD the first group guested in 2 American shows, and who replaced JYJ in Jeju ?
      MAMA is so UNFAIR!!!!! (:) ) .
      and why SM didn’t bought even a single award for the kings, at least as a token to break all records in Japan!

      I’m with you, I don’t know all the names listed, but I think they are not confined in the big 3.
      My only objection there is Album of the Year and Best Global Male Group.

    It’s kinda sad to read about the possibility of TV appearance.
    I’m sure truly JYJ fans won’t ever leave them even though they can’t appear on any TV programs.
    But, this is their dream, they want to appear ~ so we should stand up for them.
    ( Thanks to all fans who send the tips how to help our boys through twitter, facebook, etc )

    About TVXQ, reading his honest words bring tears to my eyes.
    TVXQ has a special meaning for me, because I follow and admire them since the beginning.
    I only interested with their talents at first, but then Junsu was the one who made me deeply in love. I really, really love everything about him ~ from head to toe, inside & outside.
    I once being a selfish girl, just want 5 members TVXQ reunion whatever happens, because I love their talents.
    TVXQ with powerful choreography & Tohoshinki with heavenly vocal harmony ~ no other idol groups can approach their level.
    But then I realized that their happiness mean the most to me. They’ve chosen different paths, so I should chose my path too.
    I disappointed with some of HoMin actions toward JYJ after the split, but I can’t hate them.
    Because there were many memories when all the five still together, such as how Changmin carefully took care of sick Junsu. That kind of memory will always remain.
    I honestly still listen to current TVXQ music and watch their MVs, press ‘like’ button on Youtube if I think it’s good enough.
    I still care about them, but I can’t be their fan. I don’t feel “the love” whenever I watch the duo’s videos. Dunno why.
    Otherwise, the more I know JYJ the more I love them unconditionally.
    JYJ has taught us many things about life ~ how we should try to always think positive and never give up on our dreams.
    JYJ are 3 true gentlemen who bravely fight for their rights & freedoms. They are one in a million.

      Totally agree with you. I feel disappointed HoMin actions toward JYJ as well. Maybe I’m selfish cuz I just want to hear things what I wanna hear, I think it’s pretty simple cuz I’m human. But well even I’m saying that I feel disappointed but I still follow their new, download their clip but I didn’t watch it at all. Airport fancams is fine but not their performances or listening to their songs. I just think that my feeling towards them will never be the same. I know I’m bad but this is how I feel. I wish them luck. But now my passion is JYJ so I will stand by their side forever.

      I’m sorry, but I disagree with you… I think that the fans are in denial.. Maybe to fans, JYJ seem to have won as they are “free” now ( from fans point of view).. But in reality, they are not free, nor have they won.. Winning would have been to terminate the contract, get the money they deserved and appear on TV again.. However, they have achieved non of that.. even lawyer Park Chang Jong said “contract termination of a “slave contract” with SM is inherently impossible.”… In the end, they settled to an agreement with SM’s terms, “to forget anything has happened and just move on”.. without a cent, and they still cannot attend award shows either.

      I wouldn’t have used the term “all in vain”, because at least they changed the laws for the younger generation of idols.. However, JYJ have not benefited from these results much.. As long as JYJ can’t say “we have won”, the media channels will not put them on air… that is the sad reality that we, JYJ fans, should accept… JYJ have LOST…

      I just find it heart breaking when I see the fans jumping with exctitment saying “JYJ won”, “Now we’ll see JYJ on running man”.. while from the start I knew that would not come true, at least not “now”.. and non-fans are watching us with confused expressions like “why are they happy?”, or worse laughing their asses off saying “the lawsuit was all in vain”.. while fans are stubbornly insisting that it was not, and that JYJ have won… well, maybe they have won in the fans’ minds…

      But still, despite that, jyj are standing strong, they never give up, Junsu managed to look at the bright side at how they helped the younger generation, and they also have us to support them untill the end..

        We’re all entitled to our opinion. But let me ask you this. If they didn’t win, are you saying they lost? Even using your comparison, “all in vain”, are you saying the effort to try and sever themselves was not worth it? Do you understand what the concept of FREEDOM means?

        Let me give you my comparison:

        When a person is a slave, as long as they are tied to the entity that owns them, they remain a slave. Once that connection ends, and the slave can move on with his/her life, they are FREE! It doesn’t matter if they obtained their freedom by buying it, escaping, suing for their freedom or having a war fought to free them. Once that connection is broken, the slave has won. Nothing is done in vain. Life for the former slave won’t be easy, but they at least will have their FREEDOM!

        Freedom is always worth the risk. To die a slave is to not have control over your own life. Is this what you would want for JYJ?

        At the present time it may not look like a win to some, can’t imagine why not, but time will tell. I’m putting my money on JYJ having won. They no longer have to answer to SM for damn thing. They no longer have to ask for favors. They no longer have to wonder if the money they sweat for is going to be there at the end of the day. They no longer have to wonder when SM is going to give them the heaveho and kick them to the curb. They are now the masters of their own fates. From a quote I read, paraphrasing here…the moment JYJ walked out of SME they were free men. They made the decision to be free.

        Ok, so the broadcast stations at the present time are trying to do a save face and not rushing to put JYJ on entertainment programs. None of them want to lose the game of chicken to see who goes first. We all know LSM is famous for sucking blood. But keep in mind nothing and no one is too big to fail.

        What do you think that SM stock crash was all about? SME is doing something shifty with their money and it is affecting their stocks. If you don’t think those investors didn’t jump down their throats, guess again. No huge stockholder likes losing money, especially when they were told to expect great reports for the quarter.

        Yes, it would be nice if supposed grownups would act as such and do the right thing. But this is where the fans come in. We don’t have to sit back and take it. We can begin to make noise. JYJ are not alone. I don’t know about you or anyone else, but I have a voice, and I intend to make it be heard. These broadcast stations not only air in SK, but on cable and satellite systems all over the world. Guess what? Those systems don’t like having unhappy customers. Most of them probably have SNS pages. Get the drift?

        There is no sense of denial going on here. I’ve said before, nothing worth having comes easy. As a JYJ fan I don’t have to like fighting, but I will if I must.

        Really. Well, I suppose we’ll just have to agree to disagree then. Perhaps you have a different definition of what it means to be Free after enduring 7+ years of virtually unpaid servitude. Perhaps you think little of the career choices that leaving SM have opened up for them, the successes they’ve had, the goals they’ve been able to realize. Perhaps determining your own destiny has limited appeal to you but it looks awfully much like it meant a whole LOT to these three young men. In the last 3 years of this fight each one of them has prospered astronomically in areas of entertainment that THEY have chosen for themselves. They now own all of their own work. No one can tell them what to do. What they earn, they get. Do you have any idea of what it means to work for a company where you can’t leave and who can just verbally tell you that you’ve made next to nothing for the last 6 months of hard work? And if you press the issue your punished and penalized?

        To say that they are still “not free” is frankly puzzling to me. They are OUT of SM’s grasp once and for all, no possibility of further legal action.

        “Winning” is they are out of the contract with SM. “Losing” is they have to go back. As to your belief that they got no settlement, it is completely normal for the exact terms of a settlement to be held in confidence by the parties involved. Especially, SM would have not wanted a word breathed of what they would pay JYJ considering their current stock crisis – no further shocks to already shaky investors was certainly a concern. I find it odd that because some people don’t know the exact terms of the settlement they think the worst. But quite honestly, even that no longer matters. Since you are a fan of JYJ, you know their talent, their ability to create fantastic product every time out, give amazing concerts, act, do musicals to wild acclaim and sold out houses – you must have at least an inkling of JYJ’s earning potential for the future. They have never been better, stronger or more creative. They are HAPPY. THIS IS winning.

          First of all, I’d like to thank you for actually taking the time to reply to my comment.. It must have been THAT annoying since you didn’t just ignore it..lol
          But I think you two both misunderstood what I meant by “lost”.. I wasn’t speaking in term of leaving SM or staying.. HELL COURSE they are better off out of that slave factory, what are you even talking about? And I would never ever wish for them to ever go back there… I also DO realize that JYJ have gained so much after leaving SM, as they grew both musically and matured as men.. I even grew to love them much more after they left…

          I was comparing their situation before and after the “settlement”, I meant they haven’t gained anything from it… BEFORE the settlement, JYJ weren’t able to appear on TV in their OWN country (including Japan), they were blocked from all corners, and there were obvious manipulations going on under the curtains in order to send JYJ into the oblivion… in other words, they were not “free”to appear on TV or music stations, and they were not “free” to promote their music in their own country like every other artist. This has been going on for more than 3 damn years! Then SM come and say, you know what, we are tired of this.. so lets get a settlement and pretend like nothing has ever happened!!!

          Now let’s look at JYJ’s situation AFTER the settlement…………. > EXACTLY THE SAME!! Maybe their chance to appear on TV and award shows has become “a little” better, as there are no more excuses left to make (such as an ongoing lawsuit)… However I still don’t see why JYJ fans are declaring a victory, when basically the settlement wasn’t to JYJ’s favor, and nothing basically has changed… therefore I don’t see this as a “win”..

          Maybe “butterfliesarefree2″is right in the fact that not winning doesn’t equal losing… But to me, I think of it as a loss because to me (and maybe other fans) winning the lawsuit was the only thing that would turn everything around. JYJ would have obviously and publicly won, and they would have proved that SM is just a slave shop, and even to those people who were not aware of the details of the lawsuit (such as JYJ winning the first case) and those who accuse JYJ of being greedy, it would have been crystal clear that JYJ were were treated unfairly, and that they had the right to sue SM and fight, and that they got what they deserved… There are still idiots going around saying things like “the contract was fair since JYJ didn’t win the lawsuit”, even though the court has declared it invalid.

          So yeah, I’m not sure if there will be improvements from here on… but the way I see it, the situation is “stuck”, at first I was looking forward for them winning the lawsuit to change the situation, but now I don’t know what possibly could… other than the fans… but I mean there is no real point in time or even to wait for… If there is something “real’” that I’m not aware of please enlightened me, something other than hope or optimistic thoughts… since I’m a pessimistic person in nature (T^T)… Tell, me how can JYJ appear on TV, award shows and music stations again…

          I’m taking a wild stab here, we’re dealing with a symantics problem. Let’s sort of push that aside.

          With regards to the above statement, let me try and see if I can enlighten you…

          1) JYJ under SM – painful arduous scheduling, no life of their own, hardly any contact with their families.

          JYJ now – work when they want to, when they want to, vacation when they want to, see their families when they want to.

          2) JYJ under SM – highest payoff for album sales 10%/5. No compensation for concerts, products sold with their names or images on them, no payment for personal appearances. Work their asses off only to be told there is nothing left after expenses.

          JYJ now – the agency CJeS works for JYJ, contracturally there is going to be a set fee. All sales of any products, all promotional endorsements, all concerts, all appearances, all cd/dvd sales, after all costs are paid for/3.

          3) JYJ under SM – invest in a cosmetic company in China to earn extra income. Why this is needed when they are the biggest grossing act in the company is a mystery. Company is pissed and has a hissy fit.

          JYJ now – can invest in their own enterprises and not have to answer to a damn sole about it, but their accountants, i.e. – restaurants, coffee shops, recording studio, AND, I honestly believe are now part owners in CJeS (again, no actual proof, but a gut feeling due to some very telling circumstances). This makes them businessmen who get to call their own shots.

          4) JYJ under SM – grown men living in a dorm situation.

          JYJ now – own their own homes, own their own vehicles, can keep their fan gifts for themselves.

          5) JYJ under SM – no royalties or copyrights to any thing with their names to them.

          JYJ now – everything has their names on them, and they get paid for them.

          6) JYJ under SM – slaves with no hope of a life of their own unless the master says they can have one.

          JYJ now – everything they do and say, is because it is what they want. They are free to be themselves, have their own recreational outlets, donate their own time and money to worthy causes because they want to. When they go to the bank, the money they deposit is their’s and their’s alone.

          Yes, at the present time they are not on SK tv entertainment programs. But it has been only a few scant days since the settlement was announced. These companies will not be able to keep JYJ off the airwaves forever. There will be too much backlash for that. It may not come as soon as most people would like, but it will happen. They have no legal justification to keep them off. There is no more lawsuit. Pressure from the fans will make it happen.

          And for all those too ignorant or willfully stupid to know JYJ won this case back in the beginning when the court granted them the right to pursue their activities outside of SM, and finally when the court declared that contract subjugating; that is their problem. It doesn’t change the facts…JYJ are FREE MEN now. Do you really think a few appearances on some entertainment shows can make them any happier?

          I cannot put it any other way than this, because these three young men had the courage to walk the plank TOGETHER, they made it possible for themselves to have real, honest lives of their own, come what may. It’s just that simple. Take a look at the smiles on their faces, do these look like the faces of unhappy people? ;-)

          Well, I kind of had to laugh at the above although I really didn’t do it in a mean way, but I mean, gee…. you gave it FOUR WHOLE DAYS post settlement before you reached these devastating conclusions?? Well, yes, I guess viewed through that backwards telescope the end of the lawsuit hasn’t produced much benefit.

          Honestly though, I was just baffled all over again by your consistently negative spin on JYJ’s situation. I still frankly don’t get it. Knowing everything you do about JYJ, how smart, how resourceful they and their team are, what creative, outside-the-box thinkers they are when faced with a difficult problem and then knowing how driven to succeed each of the members are in their own way and how much they’ve accomplished against all odds… none of that adds up to maybe taking a chance on believing that they are going to go forward now and kick some serious SK Music Business Butt in 2013 ?

          One more thing you said resonated with me rather loudly, it was your paragraph about JYJ having lost the chance to “prove SM ran a slave shop.” All the evidence of that anyone needs has been in on that point a long time ago. The contract was invalidated and the Korean Federal Trade Commission put in place sweeping new changes based on overhauling the contract points for all present and future artists. That’s a done deal. That’s because of JYJ’s victory in court to have their contract invalidated.

          I have a hunch though that where you’re maybe getting demoralized and frustrated is in trying to converse with very young and willfully ignorant posters on other fansites. If you’re doing that a lot and God Forbid trying to change their minds – well, there’s the problem. Then I understand. J

          You can’t. They believe what they want to believe and they make up the facts to suit their arguments. These kids are all-together not worth your time. How can you debate with people who know nothing about the lawsuit – none of the facts, none of the documentation, who are still spouting the same old SM apologist rhetoric?? It’s not possible to do anything but make yourself crazy doing that.

    JYJ should be hailed as heroes in Korea. They have helped break the mold on unfair contracts for entertainers. I hope they get to appear on many variety shows in Korea (the popular one is called Running Man)? I will not be able to see these shows, but I will be happy just knowing that they have appeared on them in the future. I am now watching and wondering if SM will pay the boys their royalties for all the years they worked under SM’s horrible contract. I hope that JYJ celebrates their victory with a party with family and friends. Pour some champagne for me, guys!

      Hi Shirley,

      Problem is under SM’s contract no royalties were due. Then or ever, probably. Does JYJ want to head right back into court and start once again trying to see accounting ledgers for those years?? Noooo, I don’t think so. :-)

      It would be another long battle in court and once again the legal fees would be astronomical.

      Here’s what I am hoping: that JYJ will look upon all of that money lost as having been spent on a fantastically expensive education in Music Business 101. No, in fact, I think they are about ready to be awarded their PH.Ds at this point. Maxima Cum Laude.
