[NEWS] 130118 C-JeS releases details regarding JYJ’s lawsuit victory over Avex

After the initial announcement regarding JYJ‘s win against Avex, C-JeS Entertainment has revealed details regarding the ruling received.

According to C-JeS, the Japanese court ruled that Avex cannot insist on JYJ’s sole management in Japan, and ordered the management company to pay JYJ’s agency C-JeS Entertainment 660 million Yen (~ 7.3 million USD). The court also acknowledged the fact that Avex has defamed C-JeS’s CEO, and as such, ruled that they also pay the CEO 1 million Yen (~ 11,000 USD).

To recap, JYJ and Avex ended their exclusive contract back in 2010 and as the conflict of promoting in Japan escalated between them, Avex had released a public notice that falsely claimed that C-JeS’s CEO was affiliated with gangsters and brought about the halt of promotions in Japan for the group. They also insisted that they had sole management over JYJ’s Japanese activities and interfered with the group’s attempt to put on a charity concert back in 2011, which led to the lawsuit.

In response to the ruling received in court today (18th), Avex has already made it clear through an announcement on their homepage that they cannot accept the decision and that they will be filing an appeal.

After legal cases involving JYJ (Kim Jae Joong, Park Yoo Chun, Kim Junsu) and SM Entertainment is completed late in 2012, now JYJ legal case with Japanese entertainment agency, AVEX, also done.

In a report received by the management JYJ, C-Jes Entertainment today (Friday, January 18, 2013), the lawsuit between JYJ with AVEX, won by JYJ. AVEX expressed should not interfere with JYJ’s activities in Japan.

During this time, JYJ’s activities in Japan blocked by AVEX who has an extensive network of business entertainment in Japan. The ban of JYJ’s activities in Japan started since Kim Jae Joong, Park Yoo Chun, Kim Junsu decided out of TVXQ and SM Entertainment. When JYJ perform for charity events for victims of the earthquake and tsunami in Japan in 2011, AVEX was intervene and prohibit JYJ perform at Japan.

With JYJ won the lawsuit, JYJ will be expected to fluttering in Japan. Considering the fan base was the largest foreign group in Japan.

JYJ resumes activities in Japan after the completion of the lawsuit

The group JYJ finally wins the lawsuit against its Japanese agency, AVEX.

On January 18, Tokyo District Court in Japan orders AVEX, Japan’s biggest management company, to stop engage in acts such as claiming exclusive management rights to JYJ in Japan. The court also ordered AVEX to pay approximately 660 million JPY (approximately 7.8 billion KRW) as compensations for damages to C-JeS, JYJ’s agency.

Tokyo District Court acknowledged the fact that AVEX made announcements that defamed the chair of C-JeS, and consequently ordered AVEX to also pay approximately 1 million JPY (approximately 1.1 million KRW) for compensations for damages to C-JeS’s CEO.

After the injunction against SM Entertainment to terminate the effects of exclusive contract, JYJ signed an exclusive contract with AVEX through its agency, C-JeS, in February, 2010. When the two parties came into conflict regarding the range of activities, AVEX suspended JYJ’s activities in Japan arbitrarily through a unilateral notification in September 2010, making false claims about the chair of C-JeS’s connections to gangs.

In response, C-JeS notified AVEX on the termination of the exclusive contract with AVEX to continue [JYJ’s] activities in Japan, but AVEX have been interfering with JYJ’s activities such as concerts, claiming exclusive management rights to JYJ in Japan. Consequently, C-JeS filed request for prohibition of interference and claims for damages and received the judgments as described above on 18th.

C-JeS commented, “We are very pleased that Japanese judiciary have acknowledged and prohibited the interferences of AVEX against JYJ’s activities in Japan.” Also, C-JeS expects to resume JYJ’s activities in Japan based on this ruling.

JYJ have completed all legal lawsuits and have been set free with this ruling, following the settlement of the 3 years and 4 months-long exclusive contract dispute with the former agency, SM Entertainment, in November, 2012.

The group JYJ has finally won the lawsuit against AVEX, Japanese Agency, after long period of legal dispute.

“Tokyo District Court ordered AVEX not to insist on JYJ’s exclusive management right and pay 6.6 billion Yen (approx. 7.8 billion Won) to C-JeS Entertainment as compensation for damages”, said C-JeS Entertainment on JAN 18.

Tokyo District Court also ruled that “It is recognized that AVEX damaged reputation of the CEO of C-JeS Entertainment [Mr. Baek] and pay him approximately 1 million Yen (1.1 million Won)”.

JYJ made exclusive contract with AVEX in FEB 2010 through C-JeS Entertainment as an acting-agency after they had approval from the Korean court regarding the injunction to terminate validity of exclusive contact against SM Entertainment in Korea. However, when they had disagreement in opinions about the range of JYJ’s activities, AVEX unilaterally suspended JYJ’s activities in Japan insisting “the CEO of C-JeS is related to a gang of racketeers” in SEP the same year.

C-JeS sent notification for cancellation of the exclusive contracts to AVEX in order to continue JYJ’s activities in Japan. But AVEX has been interfering JYJ’s activities such as concerts, insisting that it had exclusive right for JYJ’s activities in Japan. C-JeS filed the lawsuits to forbid AVEX from interfering its business and claim compensation for damages.

“We are really pleased that Japanese court acknowledged AVEX’s interference in JYJ’s activities in Japan and ruled against them. We expect that JYJ would be able to resume its activities in Japan with the ruling”, commented a staff at C-JeS. He/she also emphasized the fact the court also ordered compensation for damage regarding its CEO’s damaged reputation, saying “It’s a shameless act to interfere the artists’ independent activities by malicious propaganda”.

JYJ also finished the legal dispute with SM Entertainment in NOV 2012, and as well as with AVEX this time which made them finish lawsuits regarding these issues.

      i was totally expecting AVEX to appeal too. They know that the guys are due for army service in a couple of years. By dragging the case out with numerous appeals, they are hoping that their japanese fans will gradually forget them or lose perseverance in the support for the boys. Also, if they don’t appeal, they are basically admitting that they bullied JYJ by obstructing their activities in Japan.

      I truly don’t understand why these big-headed studios, etc. actually think they’re saving face by appealing when they’ve already clearly lost, not just in the judicial court but in the court of public opinion as well.
      I would think that a more honorable way would be to admit to a mistake, apologize and move on. I thought the Japanese were known for their honor. I suppose the Avex execs must be missing a few links in their genetic makeup.

      I should at least give kudos to the Japanese court system for, not only coming out with a definitive verdict, but a settlement to boot. As opposed to Korea’s “you settle it amongst yourselves” brand of justice.

        I totally agree with you on this. The SM lawsuit went off with a tiny ‘poof’, but this one is a great big ‘BANG!’. I like it! :)

        As far as honor goes, I’m going to assume the entertainment industry is a horse of a different color. It’s all about profit, and how you get it is not a huge ethical concern. So, Avex was simply performing up to code. The way they conducted themselves throughout this entire ordeal speakes volumes. The more I smell this situation, the more I see collusion between Avex and SME. Too much of it just didn’t make sense. I don’t think honor has a damn thing to do with it. But if they want to waste their money on appeals, let them. JYJ is going to be around for a lot longer than they think. They would do better to take that money and donate it to a good cause to earn themselves some brownie points.

        Totally concur with your comment about the Japanese courts vs. the SK courts. Got to give credit where it’s due.

      i do wish they would just admit it, swallow their pride, and pay up and be done with an obvious loss on their side. they should know by now that JYJ has persevered and are going strong on their path and will continue to do so whether avex owns up to it or not. cut your losses and move on. don’t they have bigger and fiiercer battles to fight now anyway?

    Avex, you’ve already gave up on your rights to manage JYJ when you let them go just like that in 2010, right after you’ve got them to release a mini album, hold a concert in Tokyo Dome, participated in a-Nation 2010 and released a DVD. And right after milking them for what’s their worth, you suddenly cut them off, saying that you didn’t want to get involved with gangster-related management company in S. Korea. How, and I mean HOW, on earth can you still claim that you hold management rights over JYJ in Japan????????

      Simple answer to your question … MONEY!!
      It’s like they want to please SM by bullying JYJ.
      However, though they’ll never admit it, those Avex people know exactly whose voices, images and all around star power truly sold volumes of cds and merchandise for them.
      It’s no accident the bulk of those THSK songs were built around the voices of JJ and JS as the Jpn songwriters/producers were more focused on vocal quality as opposed to breaking up lyrics in relatively equal parts between group members in order to please the fans like they do in Korea.

      Phew … My goodness. It’s a good thing I enjoy roller coasters because being a JYJ fan sure feels like I’m riding on one.

    I think they need to pay and close this case quickly. If not they will defame their agency more than they already have. Even though they are a strong power in Japan entertainment and big headed, still I hope one day they say “I made a wrong decision thus I want this to end… and move on. Case closed !”.

    AVEX’s reaction is normal, they would fight tooth and nail to reverse the decision. Although it’s futile for them to fight back, scums like this people who lives for money will not bow down easily. Too bad, as cliche’ as it may seem but Justice still sides with TRUTH, that is, with exception to JYJ’s own country… the word fairness and justice there does not apply there… they might have won the battle in paper and with words but we have yet to see the true effect of it… UNLESS I SEE KIM JAEJUNG PERFORMS LIVE IN MUSIC SHOWS i’d say it’s over… but until now i have less hope on that matter… regardless, not ours and JYJ’s loss.

    I know it’s wrong to wish for other people’s misfortune, but that’s my exact wish to AVEX, SME and the PEOPLE who runs it. I wish for them to fall flat on their faces till’ they can’t stand anymore. i wish for them to break their legs just so they can’t run and walk anymore.

    Enwei, Lets just pray that our JYJ will have a successful 2013, it’s about time for a new album, no?! :D

    Yet, Avex will try their best to shake off any liability by appealing to …2046 perhaps?

    Too late, JP market now full of hostile to hallyu. Political tension make it too difficult
    to spend time there. ( even Homin return back to Korea , into acting & fixed MC to
    enter China)

    Recent JYJ activity showed that the don’t have extra time to spare ,
    famous artists, include major Korean artists, are digging gold in China.

        @flower ~ hello. In fact the anti hallyu power has grown larger by mid of 2012. Not only affect singing idols, but also many actors & actress from Korea as. Here for some reference:

        Even Homin , who long regarded as J-pop , was not invited to Japan year end shows.
        Now this duo return back to Korea and into tv drama & fixex MC respectively.
        Their goals are to build up another fandom , especially in variety shows for Asia market , esp China.
        * SM has focus their artists & major resources in China.

        **Because between China and Korea entertainment industry,
        has signed huge cooperation esp in movie. ( 2013 many joint projects )
        In return, China many commercial fields , esp organization level, have given up all staff travel incentive in Japan.
        Instead, all will choose Korea as a destination for incentive package. eg. Amway China, 25000 + staff will
        have incentive trip in Korea instead of Japan this year.

        Even in 2013, some concerts may still running, perhaps BigBang etc , yet those contract may be made earlier
        and can’t cancel. However, in the long run, Japan will tremendously cut the chance for hallyu.
        This is reality.

        Luckily, JYJ spent the past 3.4 years develop new skills and markets. Otherwise,
        And by observation , sina China has been working with JYJ. Hope things turn better for them.
        So many provinces & chances for Jaechunsu, nowadays even F(x) Victoria ” complains “flying so busy in China,
        she has no need to do any performance in Japan.

        well yes, the more popular you are , the more flying chance you have, JYJ really has little time left IF China
        open all markets for them. :)

        Never mind Avex. Actually i don’t think it will pay a penny to JYJ. Same as SM.

          And it is more feasible to reserve a grand nice place in Korea , which becomes a regular spot for performance for JP Fans.
          Appeal takes another years & years. That is unfair to JP Fans.

      @aurora thank you for your detail information. But why has Japan become so hostile towards hallyu idols? Did Korea do something to Japan? I am still confused!! I do agree that maybe since things are like this in Japan that JYJ should just hold concerts in Korea specifically for their Japan fans.

        dear flower ,

        about the japan become so hostile so far i know because too much hallyu , japan artist start to feel they are cast away in their home one , like u know its really hard to held concert in Tokyo Dome , must really very good and very known well singer who can held concert in Tokyo Dome either for jpop artist or hallyu for example need lot of time for THSK to help concert in Tokyo Dome because Tokyo Dome really prestisious but these days hallyu singer who just entered jp market can held concert there.

        And anti hallyu spread quite fast and if im not wrong once a jp artis make comment that he sick of hallyu and after that he got fired from his agency and that makes some people more hate hallyu.

        And sorry im offense anybody but i think yes sometime hally agency company very greedy , where a place to dig money they send all artist there and sometimes people got sick coz too much , hallyu must learn to take baby step no need rush to invade the world bcoz something trush wont have any good result.

        I think other artist and management company must learn from JYJ n Cjes , they take slow step but the result very amazing , they dont shy n dont mind to start from bottom, they dont mind to held small concert as long as fans happy to watched their pef, i always think that JYJ are not Hallyu Wave because they are so different from other artist , for them to held concert in so many country not just for the sake of money but to met their fans and spead they music.

        I hope with JYJ win the trial they can meet their jp fans , i bet their jp fans missing them so much . . . ohh ya JYJ is back and Prince of Japan aka JJ is back . . . ( sorry im JJ bias but i love JS n YC too but I Heart JJ ) hahahaha

    I’m so happy this is over. Guys its pretty normal for the losing party to appeal. There was a 100% certainty that AVEX would too. Its a matter of course, but this is over.

    I don’t care how much they have to pay but just hope that the ban is lifted and JYJ , from 2013 onwards , can promote their songs like all other artists, on tv programs, attend events in all regions, hold concerts/fanmeets in all regions. I really hope they appear on shows like running man together.

    Avex is trying to save face with this alleged appeal (I’ll actually wait to see if it is actually filed). I wonder if this will put a strain on their relationship with SM since they screwed JYJ over for them and in the end they end up paying millions while SM paid nothing.
