There was a huge scandal because it was discovered that she traced her images from copyrighted photos. That looks like one of the photos from Intermodulation, and if so, it’s a copyrighted photo and not in the public domain. When you compare the two pictures, it’s more than inspiration. They’re exact. Look at the shoulders, the body, the clothing, the jewelry. Changing the face means nothing. Youka Nitta did the same thing.
Whoever owns the rights to the picture has every right to sue.
I incorrectly use the term “public domain,” it is a copyrighted image. What I meant was that the image is available to public viewing and therefore available for anyone to take inspiration from it. Has this drawing crossed the line from inspiration to infringement? I don’t know. Although the precedent you mention makes it clear that there would be an issue in Japan.
But I completely agree that if the copyright owner thinks it has, they have the right to let the courts make that decision.
